Refuses to refund sponsorship funds I solicitedfor my daughter to cheer in their program

Incident = I filed a complaint with the BBB and the company never responded. I filed a complaint with Florida Consumer Services and Angela did response and I was not satified with the results.

My complaint is this, I sent out sponsor letters from Stars Boosters, Inc. Seeking sponsorships for my daughter to cheer at Encore Cheer and Dance Co. On about May 15 a check from Miccosukee in the amount of $2000 was received at Encore for my daughter. The check was deposited into her booster club account. I was notified after the check was deposited by the owner. At the time the check was received at Encore I had not registered my daughter to cheer in their program, they did not have enough level 5 cheerleaders to form a team so I decided to wait.

On June 18, I received a phone call that I needed to take my daughter to another gym because there was no level 5 squad at Encore for my daughter for this season.

I called the owner of Encore, Angela Armas and explained to her that I was told by the head coach to take my daughter to another gym since Encore had no level 5 squad for my daughter. I was requesting for the $2000 that Miccosukee sent me so that I may return the funds back to them. Miccosukee was going to sponsor my daughter at the new gym once they received the funds from Encore Cheer and Dance Co.

Angela told me that she would have to consult with her accountant in regards to the legalities of the refund, she stated to me that in the past when a parent leaves a gym any funds in the cheerleaders account is forfeited and the gym stays with the funds.

My complaint is when the check came to Encore the owner should have given the check to nme so that when I registered my daughter to cheer for their program I would turn in turn give them the paperwork with the check. If I choose not to register my daughter in their program I can return the funds back to the company that sponsored my daughter in the first place which is Miccosukee.

Instead Angela deposited the check into my daughters Stars Boosters, Inc account which at the time had an inactive FEI number since 9/15/06. I feel I
was mislead by Angela in regards to the sponsorship letter. You can not solicit sponsors for an individual cheerleader when you are a nonprofit 501 (c) (3) organization, yet the sponsorship letter states that a company could choose to sponsor an individual or a team. Angela Armas states the samething at the parents meetings.

Stars Boosters, Inc and Angela Armas are misleading parents and companies by stating that they can sponsor an individual or a team when in fact all cheerleaders benefit from one general account equally. Angela stated
that my daughter was on a scholarship therefore I lose any funds in her account.

My daughter was never on a scholarship at Encore Cheer and Dance, Co. I paid for her to cheer there and whatever sponsorships I received from companies paid the difference.

Angela states that the Stars Boosters, Inc. FEI number was never inactive, I have documentations to show otherwise.

Angela states that I re-registered my daughter in April for Clinic and Try-outs therefore my daughter was registered for the new cheerleading season. I documentations showing that Clinic and Try-out where May 1 & 3 and the try-out where May 5. I only registered my daughter to try-out for their program. My daughter tried-out for the Top Gun Allstar program does that mean she is in their cheerleading program?

I have other concerns on this business which I have documentations to back up my accusations. All I ever requested from Angela Armas is the $2000 to return to Miccosukee.

Damage Resulting = I ended up leaving Encore Cheer and Dance, Co. My daughter is cheering at Top Gun All stars. I could really use the funds to pay for part of my daughters cheerleading fees at the new gym. This has put a strain on my pocket because I really count on any sponsorships that I receive from companies to pay for a very expensive sport.

My daughter is a straight A student and a very good cheerleader. She loves to cheer and I can not deny her this privilege. She plans on going to college to become a doctor. If she could earn a scholarship for academics and cheerleading she can attend the University of Miami, the school that she picked. All I want is the funds to help me pay for the cheerleading program she is in at this time.
