Deon's Mini Excavating & Hauling delivered topsoil to our home as per our request. We were not there when soil was delivered. When we got home after dark that night, we saw the pile of topsoil on our driveway and went to cover the pile with plastic because the weather forecast was calling for rain. When getting the plastic ready to cover the topsoil, we noticed puddles of something on the driveway due to our van headlights shining on the puddles. Upon further investigation, we discovered that the fluid was red. We believe it to possibly be transmission fluid. We took several cotton blankets to sop up the puddles of fluid on our driveway.
The next morning we went outside to investigate further in the daylight to discover the fluid sprayed over our side yard, all over our garden plants and on the topsoil pile that had been delivered the previous day. We then called PA Dept. Of Environmental Protection and Deon's Mini Excavating & Hauling. D.E.P. Called back right away and advised us that 3" of soil should be removed from the contaminated area and should be replaced with clean soil. When Deon's called us back, he admitted that his hydraulic line burst on his dump truck while on our property when he was delivering the soil. We passed along the information provided to us by D.E.P. Deon assured us that he was going to take responsibility and clean up the mess appropriately. He was just waiting for his dump truck to get fixed.
A few days later, Deon showed up with two helpers, a man and a woman. The man and woman took shovels to some of the contaminated grass and driveway. They may have taken about an inch of dirt along with the grass that was removed, but only a small portion of the contaminated area was even dealt with. Next, they started replacing a small area with dirt and part of the driveway with a mixture of dirt and stone. We had them stop replacing the soil and stone because the job was not yet ready for replacement. Deon said he would call D.E.P. To come out and test the area and he would then follow their recommendations. We agreed to this plan.
The next day, we contacted D.E.P. Again to see if they were going to come out to our property. They said they couldn't come out because we didn't meet the criteria for them to come out and investigate. We contacted Deon again to find out the new plan. We told him that we just wanted our property cleaned up. We were trying to be really decent about this, but the fluid was just going into our property deeper because of the rain and lack of cleanup. We let him know that we would seek legal action if he refused to clean up his mess. His said that he had lots of money and would fight us.
We then discovered a website, deonsexcavating.com, which states, "We provide only quality and dependable services because you deserve nothing less." and "Your satisfaction is our top priority." Something seems very wrong here, doesn't it?
In conclusion, the least we would like is to have our property cleaned up properly and fixed up with new topsoil and grass seed and new topsoil and plain stone covering the driveway, we would like to to have the topsoil that was delivered to our property that day hauled away to a toxic waste dump due to the contamination, and to have our money back that we paid to this company for the topsoil and delivery. We would like to have Deon's pay for all of this to be done by a third party of our
choice.
