My uncle purchased the furniture from Levitz about 3 years ago. When I called on his behalf to report the claim, they said although we called within 5 days, the damage couldn't have happened the way we described it.
The contract states that you have to report an incident within 5 days and their manager told me that the word incident means only one tear on the furniture. We gave them five business days to reply to our demand letter, and since they didn't respond, we are going to file a small claims lawsuit. They are in breach of contract according to CA law and I am sure any other state as well.
I just hope we can collect the judgment from them because I saw one person complaning about not being able to enforce the judgment. If I can't collect, I suggest we file a class action against them because they can't continue to operate like this.
