Failure to honor their money back guarantee

My wife and I have had a tax problem for years. And we've been trying to get ahead of it for a long time. We contacted Tax Results late spring 2011 and spoke with who I later found out was simply a marketing person, Joe Adaline. After repeated assurances from Mr. Adaline, we decided to contract with TR. His promise, and the promise prominently displayed on the website was clear: Tax Results would either save us money, perhaps a considerable amount of money, on our tax liability, or we would receive a full refund of the fee that they were to charge us.

Shortly after we contracted with them, we received a balance statement from the IRS showing we owed $17,181 on our 2010 taxes, an amount we agreed with on our tax return. Within a week or two, we received another balance statement from the IRS showing that we owed $31,911 for our 2010 taxes. We knew immediately something was wrong; my wife immediately contacted the IRS and spoke with a person who confirmed that, indeed, the IRS had made a mistake and they would look into it.

We contacted TR and told them about the statement as well as my wife's conversation with the IRS. The TR enrolled agent assigned to our case at that time was Jafar Clemons who immediately told us not to contact the IRS ourselves but to let TR handle the problem. While we thought that was odd, we went along with his request. Within a month or two, the IRS corrected the mistake and affirmed the correct amount was indicated on our tax return.

In late September or early October, it became apparent to TR and us that the promised savings they promised us would not materialize. At this time, I mentioned that I would appreciate a refund of our money, thanking them for their effort (Mr. Clemons directly). I was told by Mr. Brad Patrick that no refund would be forthcoming (by this time they were into us for well over $2,000) and that they, Tax Results, was responsible for 'saving us' over $14,000, the amount of IRS's mistake.

My wife and I both argued, unsuccessfully that the claim he was making was bogus, fraudulent and insulting as we both knew it was a mistake on the IRS's part and that my wife had made the initial contact to get it corrected.
Mr. Patrick was unyielding, accusatory and insulting in his arguments. Mr. Clemons then suggested that perhaps TR could look into another area that he could provide us with some relief, so we continued to allow them to make their case on our behalf.

After we paid them well over $3,000, they conceded their inability to find us any relief, but stated that they were entitled to keep their money because of the 'countless hours' they spent on our case. (Mind you, the money back guarantee has nothing to do with time spent; it is simply results based) We now owe 100% of what we would have owed had we never contacted Tax Results, we've had a lien placed on our primary residence and still Mr. Patrick does not budge. We believe we are entitled to a full refund of every penny we sent to Tax Results as well as a sincere apology from Mr. Patrick. But we'll settle for the full refund.
