Took Money before sending goods, did NOT send goods, been over 3 months now. Contacted repeatedly

I ordered some trim material back on April 13, JKM charged it to our credit card on the 14th of April even though they did not have the goods to send. I called several weeks later and customer service gave me some baloney about the economy and the material was on back order. I no longer have their phone number but on the 18th of june I emailed them asking them to either send the goods or give us a refund. The order # is 365227 and the amount including shipping and handling came to $43.95. The same old story was "sorry for the delay, we should be shipping in 2 to 3 weeks. It was the same last week, July 17th, "remains on back order, will ship in 2-3 weeks. We were able to purchase a similar item locally and would like our credit amount refunded if at all possible. We Thank You for any help possible.
