Ruined my daughter's wedding dress, refused any responsibility, states they have no insurance!

This company destroyed my daughter's wedding dress. The dress is discolored, torn and irreparable and they take zero responsibility and state they have no insurance!

It has been almost one year and they refuse to accept responsibility despite the manager admitted that the color is now a mud color rather than white; after 8 months of giving them time to try to resolve the issue and correct the dress, they refused all calls from me, and I finally had to take them to a conciliation board in hopes of resolving the issue. I was alone but they sent 2 lawyers and someone from the company. The lawyer was quite sleazy and lied his way through the proceeding which really bothered me.

Basically the only thing they have is the company's original receipt which states the dress was a 'cream' color, and was signed by me. I could not imagine why I would sign to receive a receipt from the cleaners. The litigator asked where was the receipt I turned in and he lied again saying they did not have it. The reason he lied was because after I handed them the original receipt, they brought out the dress which was packed and I said I wanted a box for it. Since they didn't have the box they said they would deliver the dress. When I received the dress several days later, it was sent with their receipt requesting I sign for confirmation of receipt. So my signature, if it is my signature, was a confirmation of receipt only and they don't want to show the copy because obviously it was not signed.

It does not matter that the receipt states the color is 'cream', the fact is I have videos photos and a letter from the designer, Carolina Herrera, that says the dress was white, it was only made in color white, and that it was destroyed in the drycleaning process.

Their argument is that the dress is the original color because I signed a receipt that said it was 'cream' and was torn when it was brought to them. As everyone knows a complete revision is made of the items when they are brought to dry clean. If there is any spot or button missing or any tear, it is noted in the receipt. There is absolutely no mention of anything in the receipt. The color was white, it does not matter what the receipt says in this regard, they could have put red or black, because the original color was white white white and I have the designer confirmation of this as well as thousands of photos.

They state they have no insurance on their premises, and they have a chain of stores, so this is an obvious lie, most likely in that if one thinks they have insurance one would expect an higher and immediate payment.

The dress was $6,000 US and they offered $400. The dress is now totally ruined. They must have submitted the dress to multiple dry cleaning processes, even bleaches, because the dress is still discolored but now the lace is torn throughout the dress, and the lace is brittle and dry. It looks nothing like the original dress. It is irreparable.

Since a resolution could not be made by the litigator I will now take it to civil court. I will now sue for moral damages, legal fees, the total dress at the current exchange rate of dollar/peso, my time over one year, and all expenses. Since my lawyer happens to be the father-in-law of my daughter, he won't charge me for his services, but will bill this to the dry cleaner. I will take the dress to NY and get a video and written report from the designer now, not only on the color, but the overall condition of the dress. This will end up costing them significantly more money and I will not rest until this is resolved.

What I find absolutely amazing is how this company can absolutely re-neg any responsibility to their clients. It is very important that the public realize they are bringing their clothes to a company who says they will not be responsible for any damage they do and that they have no insurance at all to cover their destruction of property. It is amazing a company can stay in business like this. I will make certain that all wedding dress establishments are aware of this.

What is also amazing is they have a fraudulent website. Their website states they are specialist in bridal gowns and take full responsibility. They state that it does not matter the condition, it will be returned like new. This obviously is fraudulent advertising because they do not return the items like new, and they take absolutely no responsibility.
