I was duped into signing a contract for a pos terminal and merchant account (Visa, MC, Discover & AmEx) all for a certain amount of money payable by check every month. I received the terminal and Visa & MC merchant account. I had to set up my own Discover and AmEx accounts. Everything was fine. I paid the first amount by check. This was back in 1998 or 1999.
Then, all of a sudden, all checks written from my checking account started bouncing. I went to the bank and after 2 hours of trying to figure out where all these automatic debits were coming from I find out it was all from Lease Comm. I had over $200 in bounce fees from them taking $20 here and $3 (property tax???) and causing my account to be overdrawn. When I questioned the agent who originally came to my house and signed me up, he didn't want to talk to me.
I packed up all their equipment, sent it back registered mail and the next thing I know I'm being sued for "breach of contract".
The person who came to deliver the court papers, passed himself off as an off duty police officer to the leasing agent of my apt. Complex so she would give him a key to enter the building (it was a secure building). He did not even knock but instead tried to open my door—I happened to be sitting in the dining room when I heard and saw the door knob wiggling. I jumped up and went to the window to see a man getting into a car that was parked about 40 feet down the driveway and then he drove away. I opened my door and taped onto my door were the court papers.
They got their judgement (date filed 6-1-00) which is now on my credit report. But they also keep "inquiring" into my credit report. One dated 12-25-00 and the other 2-7-02 and I haven't checked lately so I don't know if there was any recent activity.
Is there any way to get these people to cease and desist?
