I am moving with a friend who is going to New York and I'm going to New Jersey. I decided to share the move with her to make it cheaper on both of us. She researched companies and chose Mainline based on the quote. We declared all of our items on their inventory and clarified size with their sales representative, Bill. When the movers came to pick up the items, they packed them on the truck and told Angela (I was not present) that it would be more because we had more items than expected. We didn't have anything that was not on the BINDING quote, and had I been there I would not have let them take advantage. They came at 8pm on 8-11-10 (they were supposed to arrive early in the day) to do the move. Angela was under the impression that they had now pushed the pick-up date to 8-12-10. Once the items were loaded, the driver gave a rescission agreement and a new contract because the items were not collapsible (how do you break down a wooden chest, or a dresser, or a bookcase?) and they weren't "move ready" (we had no boxes, just furniture... How do you PACK furniture? And blankets and protective pads were included in our BINDING quote). She had been drinking wine because she wasn't expecting them until the next day and was celebrating the move with a going away get-together when they arrived. She signed the papers unaware of what she was signing. I have no legal claim to my items now because SHE initiated the contract. I immediately called them once I was informed of what happened and they have yet to call me back. They keep taking my name and number, and I've left 4 voicemails and no one has returned my calls. I spoke to an attorney friend of mine who says that since my idiot friend signed the rescission, we have no legal recourse; HOWEVER, they did not present the rescission and new contract until AFTER they loaded the items onto the truck. Legally, and as stated on THEIR OWN contract, they have to execute a rescission and new contract BEFORE they load any items or perform any services. Angela was also under the influence at the time she signed the rescission. They quoted me based on the inventory I filled out. We only put on that truck items that were on that inventory. It is not our responsibility to secure the load, pack the load, or even make sure THEIR estimations are accurate. All of my possessions are being held hostage unless I pay the difference of the old contract and new contract. I have sought counsel, file complaints with the Better Business Bureau, Attorney General of WA and CA, as well as several consumer reporting agencies such as this. Because my legal counsel is free as she is a personal contact, I will be pursuing this as far as needed.
