RICHARD D. SCHULER recently contracted an Expert Witness in support of his client's injury case. Richard d. SCHULER sent the Expert Witness upwards of 4000 documents to read and investigate with less than two weeks before the Expert would be needed for a Deposition.
RICHARD D. SCHULER was initially advised of the Expert's hourly rate and agreed to compensate the Expert at that rate.
The Expert did invest two weeks almost exclusively working on the case for the benefit of RICHARD D. SCHULER and his client.
The Expert submitted weekly invoices to RICHARD D. SCHULER's office in order not to create any surprises with understandably large invoices. Richard d. SCHULER ignored the first invoice, and like a true manipulator, only called to complain about the second invoice the night before the Expert was set to dispatch to Florida for the deposition.
The Expert traveled to Florida and met with RICHARD D. SCHULER and provided Expert testimony under oath. This testimony - despite the attorneys that requested the deposition not even finishing the deposition - caused the case to enter a settlement agreement almost immediately after the deposition transcript was recieved by the opposing attorneys.
The office staff of RICHARD D. SCHULER reported to the Expert that the case had reached a very desirable settlement of between $1 million and $2 million - three weeks after the deposition. Richard d. SCHULER had insisted beforehand that there was no way the case would not go to trial, and would most definitely not settle as a result of the Expert's testimony. Clearly, RICHARD D. SCHULER does not like to be wrong and is prepared to say or do anything to make himself feel smarter than the Expert.
RICHARD D. SCHULER was contacted regarding final billing for the Expert, but refused all correspondence until months later when he sent a defiant complaint letter to the Expert. The letter attempted to undermine the expertise and qualifications of the Expert, (who has successfully cleared the Daubert challenge, for those readers who are attorneys) and complained about how unreasonable the Expert's fee was. It should be noted that neither the letter nor any other communication from Richard D Schuler ever thanked the Expert for being the primary catalyst in the successful outcome of his case.
RICHARD D. SCHULER refused outright to pay any more money to the Expert. His justifiaction was that the Expert was too expensive (as if he had no idea how much the Expert's hourly rate was, or how much information he had asked the Expert to investigate), further alleging that the Expert did not finish reviewing the almost 4,000 documents including conducting a careful investigation before the deposition. Nevermind that the deposition led to the settlement of the case. Let it be told that at no time was there an agreement to finish reviewing the materials within any specific time frame.
In fact, RICHARD D. SCHULER has exposed himself as a very dishonorable attorney, and quite simply as a truly dishonorable, greedy and disgraceful human being. Richard d. SCHULER settled his case without needing a trial, which would not have been remotely possible if not for the devotion, skill and dedication of his Expert Witness, who happens to be one-of-a-kind in his field.
Regardless, RICHARD D. SCHULER decided to defame his star Expert both in his letter to the Expert as well as in response to a subsequent complaint to the Florida Bar - and for the sole purpose of ripping off the expert of approximately $20,000 for services rendered. Richard D Schuler demonstrated his ability to fabricate lies and excuses merely to get out of paying a bill, and to create the appearance of justification in doing so.
The Expert remains unpaid, while RICHARD D. SCHULER's case remains settled for a significant amount of money, having resulted solely from the slave labor performed by the Expert.
Most people who rely on the services of others do not wait until the service is provided to dispute the cost. This is like hiring a contractor to remodel a kitchen for a certain price, and then refusing to pay for a perfect job because the price is too expensive. The world simply does not work this way... Except for rip-off artists like RICHARD D SCHULER.
