Paid to have 2 chairs made and never received furniture or refund - Owner is hiding

We ordered 2 chairs (to be built) and was told to pay ($584.55) before placing the order. We paid by check on Oct. 11. The Purchase Order states that the furniture will be in the store in 8 - 10 weeks. After calling numerous times, beginning around Dec. 15, no one had answers for us, and no one would return our calls.

Beginning around Jan. 19, the owner (Wes Cernosek) no longer had the store open and would not answer the business phone. We made several trips to the store and managed to catch him there last week (Jan. 23). He promised a full refund if the chairs were not there by Mon., Jan. 26. He told us the chairs were on a truck headed to his store.

After several calls (not returned), we drove to the store at least 3 times to tape a message on the doors. Still no calls. A neighboring business told us that Wes Cernosek lives in a house right behind the store. We were also told that several people have been looking for him. We drove to the house behind the store and got the license plate numbers off his 2 vehicles. He had a big dog tied to the front door so no one could come to the front door. There is also no address on the house. We waited outside his house until he came out. He was shocked to see us. He promised he would have our refund tomorrow (Thurs., Jan. 29) in cash at his store — that he will be in the store all day. (yeah — right!) We have purchased a copy of his DBA from the County Clerk with his TDL #. We will attempt to find him again tomorrow to get our refund. If he is in hiding, as he has been, we now know where he lives and will have the police go to his house, and we will be filing a lawsuit in Small Claims Court.
