Pollack and Rosen went to court to file a judgment in 1997 against my husband for Columbia Medical Center. Our son had emergency surgery and we did not have medical insurance for him.in 2006 they went back to court and filed to have the judgment vacated. It was vacated without prejudice. We were very surprised but it was accepted by the court and I believe that made the judgment null and void. I have papers from the court to verify the vacated judgment. They even sent someone to my husbands work back in 2006 which surprised me since they know where we lived and had no reason to approach him at work.
Just received a letter today in the mail Dec that they are attempting to collect on the judgment! No money amount was mentioned for the original debt, they just asked for a credit card payment... Very odd.
Can they reinstate a judgement without notifying the court or taking legal action to notify us before doing this? Is this illegal?
