On-line shop: sent defective item Culver City California

This online shop caused a lot of headache to me and still is. I saw at Macy's nice Ed Hardy T-shirt, which was pretty expensive. After I checked the Ed hardy online shop it was on sale 50% off the price! I was very excited and ordered it from the site. I need to mention they require to send your photo id and credit card scan, which is very unconvinient. Most of the representatives are unavailable, so I spent a lot of time on the phone trying to reach them and make the purschase. After I received it I was surprised to see very very small (naroow) t-shirt, in which I guess nobody, even a small kid could fit!!! It was obvious defective item, that'e why I guess it was on sale, but nowhere on the site was mention it was defective (I tried on the Small size in the department store and it fitted perfectly).

So I called them the next day and explained the situation. Girl said to me that I can't return it, and I wondered why, she said because items on sale were not returnable. (Nowhere on site I didn't see any warning that I can't return sale item!!!) I replied that this was not sale, but defective item, nobody can fit in it!!! She still refused to agree with me. But after some time she called somebody else and they finally agreed to accept this item...

I am still waiting for refound, I hope everything will be fine, but this purschase costed me many time, energy and shipping costs!
