Sprint unresponsive to complaints about early termination fees

Dear Sirs:
In the month of August we entered into a contract whereby you were to provide bundled services which included cell phone, home phone, and Dish TV.

In the ensuing thirty seven months you never succeeded in bundling the services into a single bill, not even once before or after the transition to Embarq.

Out of thirty seven months it was necessary for me to call thirty-three times to correct billing errors consisting of over billing, under billing, double billing and not billing at all.

No call to your customer help line was ever answered in less than fifteen minutes on hold while having to listen to your advertising what great service you provide.

Month after month, year after year the billing problems continued with your service people continually apologizing and insisting that the problem was now solved until of course the new error filled bill arrived.

When I needed technical assistance with Dish TV neither Sprint nor Dish would take responsibility preferring to bat me back and forth between the companies until I threatened to quit the services altogether, which in hind sight I should have done.

Among the common errors on the bills were: failing to bill for my cell phone and then text messaging me on my cell phone telling me to pay up or be disconnected, this continued for eight billing cycles all requiring me to contact you to settle the issue, always with an apology and an insistence that the problem was corrected.

If you did bill for the cell phone, you didnt bill for Dish TV again requiring me to call again waiting interminably on hold for your agents who invariably were unable to correct the errors.

Then with the creation of Embarq I would get billed from Sprint and Embarq for my cell phone with Embarq telling me to ignore the Sprint bill and Sprint telling me to ignore the Embarq bill.

Until Embarq finally told me to pay the Sprint bill as I apparently was now serviced by two providers, Sprint for cell service and Embarq for Dish and my home phone, all of this without my consent.

I have all the bills and all the notes I made during the calls to correct your errors.

The final straw for me was when one of my receivers for Dish was not working properly and my call for service was handled in this manner: The service tech advised me that they could run a test of my system but if the test failed I would lose all my receivers and I would need a tech to come to the house for repair. A technician was available the next day so I gave the go ahead for the test, which failed and dropped all my TV receivers, at which point I was told it would cost $100.00 for the tech to come and repair your faulty equipment.

At that point, September 19 I decided to end my relationship with Sprint and Dish TV for breach of contract and fraud. Accordingly I canceled my contracts with Sprint and Dish TV.

My attempts to contact Sprint to explain my position were met by the runaround and transferring me from one customer support agent to the next until finally after being on hold for fifteen minutes the phone dial went to a busy tone effectively disconnecting me.

Sprint is guilty of breech of contract for never having met our original agreement namely bundling my services, therefore I have no obligation to continue my agreement with you as a paying customer.

I do not owe, nor will I pay an early termination fee and am quite willing to use the courts to enforce my rights.

I note with interest the Case in the Appellate Court of the 5th District of Illinois No: -05-0354 Jessica Hall vs. Sprint Spectrum which has been granted class action status and I will be investigating joining such a suit or creating my own here in Florida if you do not waive the early termination fees.
