I'm a first and last time shopper at florida gun works - i bought a product that was described in an ad as" HK 94/ MP5 collapisble stock complete * in stock. $399.95" before doing so i opened the link and the ad read " Collapsible stock for use on preban HK MP5 and HK94 rifles. Not to be used on a post ban weapon. Brand new condition. While supplies last.
Which Sounds like a legal disclaimer which anyone familar with the Brady bill would understand. Example you can not by law attach a stock to a pistol without a AFT stamp, because of barrel lenght laws etc. Depending on the firearm (which would apply here)
THIS PRODUCT IS A SLIDING COLLAPSIBLE STOCK USED ON THE HK94 and HK MP5. So i thought, sounds like the real mccoy. There were 8 other items advertised on this page, where pro nouns where used, example ; #1. Hk stock made by chaote, #2. Hk contract handguard, #3. Hk factory a2 buttstock, #4. RAS handguard for MP5/ HK 94 style rfles. May reqiure some fitting, #5. HK 94,91, 93 Cetme, side folding stock. Will fit HK 91, G3, HK94/MP5 AND HK 93 rifles made by Choate, #6. HK SP89 / MP5 vertical foregrip. New condition All NFA rules apply, #7. MP5A5 / A4 RIS handgaurd. And last # 8. Original HK 94/ MP5 latest generation collapsible stock, high quality, German made by HK, Not a gereation 1 a3 made by POF or MKE.
Reading through these ads i thought, this must be an HK collapsible stock. It was described as such, it did not say made for or list another manufacturer, as do the other ads. And the price was fair, not cheap nor expensive. Everything looked right. I thought HK stock gen 1 for $399. Is fair, I didn't need a Gen 3 for $599., heck my HK was 1980's era, pre ban not a 90's model. Mention of the expected legal disclaimer. These guys must be on the up and up.
After receiving it a week later, my first thought was bait and switch... It was junk, poor quality, fit, finish, workmanship. This was a very poor contractor grade part, not made for HK. But an after market, back alley piece. Pure junk!
Anyone who knows of the HK name, knows HK is synonymous with High Quality firearms - and owner's of HK's having usally paid a premium for the name can be rather particular.
I replied via e-mail, i'm returning your item it was not as advertised, your advertisment stated "HK94/MP5 collapible stock complete"... Did not say collapible stock "FOR" HK 94/MP5. And that i expect a full refund and would not be responsible for the 20% restocking fee, because the item was misrepresented.
I then receive the repley from Matt, of Florida Gun Works. Check out the use of pro nouns... Now they can discribe it..." The item you ordered is not described as being HK original, we have the HK original stocks on the website for 599.00. You obviously ordered the contract model that is cheaper, but still works perfectly. We are straight forward as can be and we do business honorably. Your return info is below, as soon as we receive the return we will credit your card.
Yes this sounds good but they will hold 20% of 399.95, aprox $79.99.. And i would give $ 10 for this crap.
-sounding like intentional bait and switch...
I'm think yea so you can sell it again and sucker someone in for another 79.99.. Just keep on selling the same item over and over., oh and now it's a Contract model? Notice they used the term contract model on item #2 but not on the item I purchased.
I wrote back trying to give Matt a chance to be Honorable.." Dear sir / madam, you are correct the item was not described as " HK original" as am I correct, as this product was OBVIOUSLY not described as an "HK CONTRACT MODEL" either, as you have described it previously in your reply, thank you.
I'm not resposible for your falure to describe this product in your ad as a CONTRACT MODEL, as you knowingly clearly state that it is. Is this really as straight forward as you can be?
I would include that this product arrived with a burr on the base of the receiver end, and is malformed, surface caoting is inconsistent / uneven, showning poor quality of workmanship.
I'm certain you strive to do your best, and things can slip through the system, which is understandable - However my initial dealings with Florida Gun Works / Florida Military Supply has been less than satisfactory.
As you have stated you conduct business honorably, which I'm sure you do. Now you have a chance to do the honorable thing. If not, I will pursue other options.
I must have hit a nerve. The final repley from Matt, of Florida Gun Works" Your opitions are as follows, Return for exchange, or return for refund minus restocking fees per our terms. I'm not going to get into an argument over semantics. The Item was described in the describtion, you Obviously thought you were ordering an original Hk stock -that was your mistake not ours. Please refrain from idol threats as we have done nothing illegal here, you agreed to our conditions / terms before ordering and these are our return guidelines.
I'm willing to exchange it for a better looking one since you say the one you got was not to your specifacations. You have the Ra# so send it back so we can get this taken care of.
Again, you can see by the reply from Florida Gun Works -
they knew this item was inferior but left this info out of the discribition.
As a consumer you are expected to be a mind reader and understand that when an item is advertised as a HK collapsible stock, it's not really an HK collapsible stock? Unless it says' Original, or genuine, factory, etc "pro nouns ", which is bull. All they had to do is add the word " FOR" and I would have known it was not an HK stock... EXAMPLE: (collapsible stock FOR HK 94/ MP5).. Then it is clear it is NOT an HK product... Whats up with Florida Gun Work's semantics. JUST SAY WHAT IT IS.- Oh I'm sorry i thought they did.." HK94/ MP5 collapsible stock complete", that's what I expected - and now they expect 20% restocking fee? Because they couldn't sell a "contract model HK collapsible stock complete " for $399.95
I drive a VW. I don't refer to It as a Genuine VW.
If I sold my pistol, the ad" SIG P210-5L V.G. Cond. For sale b/o Not genuine SIG p210, Original P210, or factory Sig p210.. Just what it is exactly.
I find it very disturbing that in some of Florida gun works ad's re describtive and others were not..
EXAMPLE ; I'd bet that item #6 is also a cheap imatation as well. Although described clearly as a HK sp89/MP5 vertical forearm, it might best be advertised as a Vertical forearm For Sp89/MP5?
Well anyway that's my logic I could be all wet...
My final repley was; (and I didn't swear)..*#@ ^*%!!
Matt, the item is being returned. For refund
I have no quarrel with FGW's terms " return guidelines"..
However there is no clause pertaning to misinformation or misleading information on your part.
If you wish to proceed and hold the 20%, i'll further other options. As far as semantics, in a prior e-mail ;
YOU described the item as a contract model in response, but it was not decribed as such in your ad.
THESE ARE YOUR WORDS NOT MINE_
THE FACTS ARE _ Heckler & Koch "HK" is a brand name synoymous with high quality firearms. You admitted in writing, you knew the item is a "contract model", Not HK. No where in the advertisement is it stated, that this item is or is not a "contract model ".
And buster you sold this via the internet across state lines...
I'm not making idol threats. Well this is my experience. Please check out the web site
[email protected] look at the ad's. The more i look the more enraged I become..
I've been around, and have bought and sold over the internet and never had been mislead in such a way that seems to be done intentionally... I'm not a lawyer and i'm aware of "buyer beware ".. And it would seem FGW's is working that razor edge to their advantage...
This reminds me of the story of the old counrty dime store, they kept a broom leaning against the counter... Everyone who past the cashier would be charged for that broom, if the customer w caught it, the clerk would appoligize " we're sorry we thought it was you broom " and refund the money... But if it wasn't caught. Can you imagen how many times that broom was sold that day.., do this with a pack of gum, a newspaper, or a gun stock well you get the idea.
P/s if anyone has advice, knowlege on this matter please pass it on if I would be refunded the 20% I will gladly donate it to this site or to the cause of your choice, just to get these bastards - And I'll put it in writing
good hunting.
