The first person I spoke with was responsible for messing up the order. Last Friday I called to change the orders to 31 and 1st. Rafa assured me last Friday on the telephone that I would not need to change the dates from 30-31 because all pickups of the car and household goods would be on the 31. He told me don't worry you will not need to change the order. He should have just changed it right then and there.

My requested date changes from the original 30th to 31st to the 31st and 1st where communicated to several persons in your office via telephone. Ms. Johnson sent me a fax with error and I corrected the mistake. The only record we have in evidence other than the telephone conversations is the following email and its attachment. All other verbal communication is deemed hearsay.

As you will notice in the email message and attachment that I sent to Ms. Johnson on the 29th, I had manually changed the dates to the 01/31/07 to 02/01/07. Under basic concepts of contract law if the party to whom an offer is made materially changes the terms (In this case the date change), there is no acceptance of the offer.

This means two things:
a. The original dates of the 30th - 31st are still in effect; or
b. The terms of the counter offer (31st and 1st) are in effect.

Because Ms. Johnson did not respond to either phone calls, or emails with the above information, it will be held that the counter offer for the dates of the 31st and 1st stand. Should Ms. Johnson have objected to the terms of this counter offer, then she should have responded within reasonable time. Because Ms. Johnson did not object within reasonable time, the counter offer stands as terms of the contract.

There where 3 sets of drivers. The first arrived 3 days too early. Without any notice. The second drivers where verbally abusive when I asked to see the weigh slip and then when I was on the telephone with World Moving Services to make sure they were the right drivers and following the right procedures. The drivers where yelling aggressivley and came into my house. They made my mother and me feel very uncomfortable and in fear for our safety. Our gardener quickly came to see what the problem was. The drivers then made quick haste and yelled telling us they were going to make us pay anyway.

I then called world wide moving and asked to speak to a supervisor. I was directed to Sarah Sanford. She was rude and blammed me for the drivers leaving. I requested a full refund which she still denied me. She said I would not get a refund unless on the evening of the 2nd no driver had arrived. However, my dates where contracted for the 31st and 1st. I have a fax that I sent confirming this.

Susan continued to threaten not to send a driver and to keep my money. And continuously did not admit to the fact that her drivers where harrasing me. I was on the phone with Jay Rafa when the drivers where verbally abusing us and held the phone so he could hear and he did admit to that fact.

Susan further continued to deny that I had send a fax that requested 31, and 1st however I have a copy and I forwarded the copy to all addresses that I had in the organization.

The first drivers also did not have the weigh slip nor did they have blanket pads, futher their truck was composed of parts strewn and loose items which would be a threat to the safety of my items. The first driver was out of Pheonix (possibly AT trucking - Im not certain of the name of the company)

I have a copy of all emails and faxes representing the above statements. And I have spent several hours speaking to these incompetent people.
