I feel that the real-estate agent had a duty to reveal all of the facts of our property before it was sold to a new owner.
I had told Peter Naisbitt that our water well also gave off Methane gas. Used as a home heating fuel, this gas could save the new owner thousands of dollars over the term of his/her ownership.
I had also offered the prospective purchaser a second morgage to help with the sale of the property.
We had vacation time back at the old home town at Christmas. I went to the new owner and asked him about all the details of the sale. He told me that he had not been informed of the gas or the offer of a second morgage.
So; No full discloser of the property condition or offer of a second morgage.
I think that Peter Naisbitt of Re/Max Simcoe Ltd. Should do the right thing and return the comission that was paid to them.
I won't ask for the differance in sale price and the listing price, even though I will be out over $18,000.
I am not holding my breath.
