To whom it may concern,
I am formally filing this complaint against SERVICEMASTERS/TRUGREEN CHEMLAWN/IDAHO LAWN SERVICE
I have incorporated the use of their services since August to come to my home and maintain my lawn by providing fertilizer and weed control.
I have constantly informed them that I had two dogs in my back yard and that NOTHING WAS EVER TO BE DONE UNLESS I WERE PRESENT AND ON THE PREMISES. I have also constantly instructed them that for them to perform this service I was to be called and a time set to arrange for them to complete the task. This request was and has never been honored. I have previously come home to find that 1/2 the job had been done and an invoice left on my door demanding / requesting FULL payment.
The back yard to my property has a six foot security fence around it, and has a padlock through the latch to prevent anyone from entering the premises without my authorization.
Twice this year Idaho Lawn came to my home to complete the services I had requested without calling me before they arrived. Fortunately I was home and able to get my two animals inside before they sprayed. Both times they completely burned the lawn so I called to have them come out, inspect the property, and resolve the issue.
On Saturday, August 6th I received a call stating that they would come to my home to inspect the lawn and would send someone (a field manager) who would inspect the lawn and provide a resolution to the problem that they had destroyed my lawn. They also stated that they would not come unless I returned their call.
I immediately returned their call and requested that I would very much like for them to come and instructed them that I did not wish to have the spray applied again as that was what damaged my lawn both previous times and that perhaps a granular should be applied instead. I also instructed them that I had two very expensive dogs in my yard (an AKC Registered Golden Retriever and Newfoundland Hound, both of champion bloodlines) that were to be used for breeding purposes and that NOTHING WAS TO BE DONE WITHOUT MY BEING PRESENT.
On Monday August 8th I received a return call stating that a field manager would be sent out to my home at 3:00 pm to assess the situation and determine a solution to the ongoing problem. I again stated that nothing was to be done on the premises without my being present. The person on the phone assured me that my request would be honored.
As we had agreed, I arrived home at exactly 3:00pm to an Idaho Lawn Service Truck parked in the front and the field manager waiting in my front yard. As I approached I asked what he thought we should do about the lawn and whether a granular would be applied.
At that time he went to my front door and pulled out an invoice stating that the property had already been SPRAYED. I told him that that was exactly CONTRADICTORY to my previous instructions and that I'm glad I had locked the back gate to protect my two very precious dogs.
he then informed me that the back yard had also received the application. I was horrified as my two my precious animals were of an affectionate nature and would follow and express their affection to anyone who came trough the gate.
I told him there was no way possible as the gate had a padlock through it preventing access.
Upon closer scrutiny, i found that the technician from idaho lawn service had taken a stump from a nearby woodpile, stood on that, reached over the six foot security gate, removed the padlock, entered the premises without my permission, and sprayed my lawnand poisoned my precious dogswith pesticide.
The field manager also at that time entered the back yard with me and UPON HIS INSPECTION, CONCURRED THAT THE PESTICIDE HAD BEEN APPLIED TO THE YARD. AND ALSO MY LOVING ANIMALS.
I escorted the field manager to the front of my property and then informed him that he should leave the premises, go back to Idaho Lawn Services and inform his superiors what had transpired.
Two hours later i noticed that both dogs were violently vomiting, stagerred when they walked, and seemed to be twitching and shivering. I immediately placed an emergency call to my vet. Presently both my precious animals are hospitalized under the care of magic valley vetrinary clinic here in twin falls.
Needless to say i'm extremely upset.
Any REASONABLY INTELLIGENT person would know NOT to spray pesticides around animals, or anywhere where there had been specific instructions left not to APPLY ANYTHING WITHOUT MY BEING PRESENT. THEY ALSO WARN ABOUT HAVING ANY PETS IN THE VICINITY AND RECOMMEND THAT THEY BE REMOVED FROM THE AREA FOR TWO HOURS IMMEDIATELY AFTER APPLICATION.
I am also extremely upset that servicemasters/trugreen/idhao lawn believes it has the right to break in and enter my property apply a pesticide to my lawn and poison my dogs. When i previously and clearly stated that nothing. Absolutely nothing. Was to be done without my presence

Upon speaking with their customer representative Kimberley LimbsI was informed that neither SERVICEMASTERS/TRUGREEN/IDAHO LAWN was responsible for the technician's actionsand that the charge of Criminal Trespassing was solely his responsibility. I STRONGLY disagree. The technician was on my property as an EMPLOYEE OF THEIR COMPANY AND WOULD NOT HAVE BEEN ON THE PROPERTY WITHOUT THEIR AUTHORIZATION.
At the time of this letter TRUGREEN CHEMLAWN/SERVICEMASTER and Idaho Lawn Service continually disavow any responsibility in the matter.
As I continued taking care of my dogs, I noticed that I wasn't feeling well. I was nauseated all the time and felt as though I wasn't breathing properly. I hadn't given any thought to the fact that I may have been affected by the pesticides that had been so carelessly and inhumanely sprayed upon my animals.
I was rushed to an emergency room at the regional hospital and treated for Anaphylactic Shock. When being questioned by the attending physician I informed them that the only thing out of the ordinary was that I had been taking care of my two animals who been sprayed with a pesticide applied by IDAHO LAWN SERVICE/TRUGREEN CHEMLAWN / owned and operated by the corporate entity SERVICEMASTERS.
I returned home that morning, and again, that evening was rushed by ambulance to the hospital again to be treated for Anaphylactic Shock. This timethe condition had worsened to the point that I had to be admitted for hospitalization for four days.
After speaking with representatives of TRUGREEN CHEMLAWN/SERVICEMASTERS, I was told that the company would be in close contact with me this week. I have placed ten calls to their Legal Dept only to be given the same "please leave a message and we will contact you"... Although refunding $60 I spent for their services this year after having my lawn "scorched" and ruined TWICE, they refuse to address the other very important issues at hand...
To date, no one has responded to my inquiry.
I feel strongly that servicemasters/trugreen chemlawn/idaho lawn services be held accountable for their actions
Be warned, do not allow servicemasters/trugreen chemlawn or idaho lawn services to poison you or your animals
