Almost 5 weeks Waiting & Item Arrives Crushed! - This Is End Of Control (Autographed) by Cherri Bom

In November I placed an order with BandMerch.com. The site said orders take 3 to 5 days. I had placed an order after going to Hollywood Records band Cherri Bomb's store link on their site. I ordered 'This Is End Of Control' as an Xmas gift. One week passed, 2 weeks passed, 3 weeks passed and then 4 was nearing. I emailed asking where my item was as I had not received an email stating that there was a delay or that item had been shipped and there was no tracking number mentioned either. After some time passed I got an email and said it was on the way. Due to an error I didn't get it til after Xmas. I then open the package and the item is completely crushed. I waited 4 or 5 weeks and $26 dollars and some change for this?!? So I took some photos although my camera and the lighting aren't great. I sent a note to the band and the bands manager prior to taking the photos. Their manager replied and said on Wednesday they would look into it. I took some photos and attached them to an email to send as my reply so they could see what kind of service the company they are selling their merch threw sends. As well to mention I wasn't the only one with this experience at least 1 other person posted on the bands Facebook telling they had same issue too. And also on other review sites ppl had this issue and on Band Merch's own Facebook there was several ppl who had this problem or worse. All we want is what we ordered in good condition, good timely communication and items sent and received in a good fair timely manner don't think that is too much to ask. So now I am awaiting a reply from BandMerch.com and hoping they will just send me another that is free of damaged/defects and at no cost to me and because I provided photo proof they wont make me send the crushed one back. I shouldn't have to fork out another dime nor spend another minute of my time trying to get the item the way it should of been all along.
