Once again a small business is being bullied by a large company, and it is not Walmart; it is Fuller Reality
I am the owner of Bailey Connor Catering, located at 8741 and 8743 Katy Freeway, Houston, TX 77024.
We have been at this location under the name of Bailey Connor Catering for 16 years. We have a commercial kitchen and office space. Prior to me purchasing the company it was operating under the name of Frank Henry Catering and Cake
Affairs at the same location. We cater many weddings and social events throughout the Houston area.
I am leasing the space from NU-WAY, LLC. We have enjoyed a very beneficial mutual relationship.in the beginning of the year Fuller Reality purchased all the buildings next to us in the strip and approached NU-WAY, LLC. To sell their portion (8739,8741 and 8743) of the strip to them; however NU-WAY, LLC. Are not interested to sell and are very happy to have us as a lessee.
Since NU-WAY, LLC has refused their offer to sell; Fuller Reality has made my life very difficult.in the past 16 years we were able to park our delivery vans in the back of our building for loading and unloading for our events. That meant we had to drive through their official parking lot behind their building. We also were able to park our vans in the back of our
building and used part of their parking lot for our employees to park. Their parking lot is huge. Our dumpster used a
very small portion of their parking lot as well. Fuller Real Estate has insisted that we move our dumpster away from their parking lot, which we did. We had to move it twice at $95 dollars each move. The first time they said we did not move it far enough. We are talking feet, not miles. Because of the limited access to the back of our building it is more difficult and time consuming to load and unload our trucks and causing my company to lose revenue.
After putting so many restrictions on us, making it more difficult to do business for us, they have now decided to build a fence around their parking lot. This means that the Republic garbage truck will not be able to pick up the dumpster any longer. I am not able to keep the dumpster in the front of the building, due to city restrictions.
We have tried to be neighborly with Mr. Darnell and Fuller Realty and have met all of his requests. He is aware that according to Texas health codes I must have a dumpster and it needs to be placed according to the codes. It is very apparent to us that because Fuller Real estate is not able to reach an agreement with my landlord for the sale of the property, I have become the victim of a large company using me and bullying me by trying to take away access to the dumpster. Therefore I am not operating my business according to Health regulation and my business will be in jeopardy, forcing me to break my lease and move. If I am bullied from this property Mrs. Eng, the owner of NU-WAY will be more willing to sell the property to Fuller Real estate. I would like for Fuller Real estate to be neighborly and help me out by simply allowing the garbage truck to continue to use the back area to empty the garbage dumpster or NU-WAY LCC to build a cover around the dumpster, so that it can be moved in the front, or work out their differences and come up with a solution for me.
I am a small business trying to make a difference and contribution in this great state of Texas. This friction between Fuller and NU-WAY, LLC is causing me time, money and worries. They are compromising my business while they are playing games with each other trying to make the most money and best deal for themselves.
