On behalf of Sofia Lipman, counsel for Century 21 Real Estate LLC (“C21”), C21 is the exclusive licensee and/or owner of various trademarks, service marks, designs, logos, colors, color patterns and business methods for use in the promotion of C21 services, products, programs and marketing, all of which are on the principal register of the United States Patent and Trademark Office (the “C21 Marks”). C21 has the exclusive right to sublicense the use of various trade names and service marks, including specifically the trade name “C21.” C21 or its predecessors have continuously used each of the C21 Marks since the date of their registration and these marks are in full force and effect pursuant to 15 U.S.C. § 1065. C21 has given notice to the public of the registration of the C21 Marks as provided in 15 U.S.C. § 1111. C21 uses or has used the words “C21, ” among others, as abbreviations of its brand name and has the exclusive right to sublicense the use of that name.
I am hereby putting you on notice that “Teran Realty” is no longer affiliated with C21 and has no right to use our federally-registered trademarks or trade names. Accordingly, I am requesting that you immediately remove the following listing from your website: http://century-21-teran-realty-llc-reviews. Usacomplaints.com/8929071 representation on your website that there is an affiliation between “Teran Realty” and C21 is inaccurate, constitutes improper use of the C21 Marks, and could expose usacomplaints.com and its operators to further legal action.
I hope that further action is not necessary, and that your continued display of the C21 Marks in connection with “Teran Realty” was simply an oversight or due to lack of notice of termination of the referenced affiliation. Please confirm to me by return e-mail within 5 days that you have removed the referenced material so that we can close this matter.
