This is about Continental Communities, Robert Fitzgerald Spring Rd # 600

I bought a mobile home their park, Lincoln Park, in August. It was 9500$, but I paid 4300$ to the owner, Dianne, and 1700$ to Continental Communities, which was a total of 6000$, and then was to pay 200$ a month to Dianne until it was paid off and then I would get the title.
We thought the park would be a nice quiet park like it was advertised, but it was not.in the rules in regulations it said that they will not tolerate acts of drunkenness, or other immoral behavior, and that they did not allow loud motorcycles, mufflers, or music. At the park there was someone drunk yelling for their f'in food and phone all day during labor day, a couple arguing at all hours of the day and night, there were about 7 loud motorcycles and people going in and out at all hours of the day and night blasting their car radios and cars with loud mufflers.
The noise was unbearable. So we moved Nov 1, and the mobile home was put back up for sale at 10,000$.
You expect the park to be the way it was advertised and for the rules to be enforced/followed. What is the point of having them if they are not going to be enforced? Then when you move it is too bad.
When I decided not to keep the mobile home after all, Continental would not give me back my 1700$ with no explanation as to why, and Dianne would not give me back my 4300$ with no reason why. There was nothing in my contracts that said I wouldn't get any of it back or that they could keep it if I moved or decided not to buy it after all.
I was told by Lincoln park's manager, Jane, that when the mobile home sold I would get my money and Dianne would get hers. Jane said that both of us had to be at the closing, and we both had to sign, and she would call and let me know when the mobile home sold.
In December and January of I got laid off from my job and wrote to Dianne and told her that I couldn't afford the 200$ for that month and if she wanted me to keep paying that or if she wanted to wait until it sold to get the balance. But I never heard back from her one way or the other.
One day when I was checking the Internet, I found out that there was a sale pending on the mobile home, but heard from no one about it. Finally on the Internet a few weeks later I saw that the mobile home sold.
So we called the park manager, Jane, and asked what was going on and why she didn't call me and she said that Continental Communities and Lisa and Scott McCullum the Agents for Lincoln Park in Steven's Point WI told her not to talk about it with me and she said we had to deal with Dianne. Again Jane was called and finally she said that Dianne had already got paid and that she wasn't going to give me my share of the money because we didn't give her a 30 days notice and because I defaulted on my agreement.
I was told earlier by Continental that I was the legal owner of the mobile home, but that it was up to Dianne if she wanted to give me any money or not when it sold. And when it did, they said that I wasn't going to get the 1700$ back and that Dianne didn't have to pay me because of the reasons she gave.
No body told me that I had to give Dianne a 30 days notice, and why should I have when I was the legal owner of the home. I also tried to work it out with Dianne about not being able to afford the 200$ a month when I got laid off because I didn't want to loose my share of the money but she ignored me.
Plus since I was the legal owner, when the mobile home was put back up for sale, I was the seller, not the buyer anymore so that entitled me to getting my share of the money back when it sold. I had nothing in writing or in my contracts that said I had to give Dianne a 30 days notice if I moved or that I wouldn't get my money back if I stopped paying her the 200$ a month or that I had to keep paying her in order to get my money back.
I went to a lawyer to see if there was anything legally that I could do to get my money back. She looked over all of the paper work I got and she said that according to my yellow contract and settlement sheet, the mobile home was sold out right to me the day I paid the initial 6000$, because that was the sales price listed on the yellow contract and settlement sheet, and that made me the legal owner of it then, should have gotten the title at that time, did not owe anybody any more money, and was not legally obligated to pay Dianne 200$ a month, nor did I have to give Dianne a 30 days notice, and that the paper Dianne had made up to pay her the 200$ was not legal or legally binding, although she tried to make it look that way with an unknown signature on it.
My lawyer said that when the mobile home sold, I was the one who should have got paid, not Dianne. I also should have gotten my 1700$ back from Continental. They had no right to tell me it was up to Dianne to give me my share of the money when the mobile home sold or that she didn't have to give it back to me.
Mr. McCullum and Continental had no right to tell Jane not to talk to me about the sale after it sold and Jane had no right to give Dianne that money when it did and they had no right to keep that sale quiet from me.
Beware when buying a mobile home from this park!
