Ripoff Passing fraudulant charges on to home owner as it was easier to squeeze the home owner rather than persue roofing contracto

Riverwalks board of directors hired a roofing contractor, Gold Coast Roofing, to perform reshingling and repairs to 340 townhome units within the community. This is required to be done no more than 15 years after each building was built although they did not reshingle/repair my roof until 17 years after construction. The contractor was to use regular and specific fire rated plywood if and where necessary and only replace plywood that was damaged. Not only did the contractor attempt to practically re-roof every building, they did not use one sheet of the less expensive regular plywood. Homeowners have received bills well over $1,000.00 per unit. The association finally realized Gold Coast Roofing was acting in a fraudulent manner and fired them and hired what they claim is a more reputable company.

The new company has only had to replace plywood on one building (8 units per) out of atleast 15, versus Gold Coast Roofing replacing almost the entire roof on every building they touched. The home owners fortunate enough to have their roof reshingled and repaired by the new contractor have not had to pay ONE DIME. Although the board of directors admits to being aware of the fraud committed, they insist on charging the home owner and threaten to forclose on homes rather than go after the contractor/thief or use reserve funding. They have even gone as far as applying quarterly assessment payments to the special roofing assessment and claim members are failing to pay their quarterly dues. They reject any regular assessment payment now, claiming it is not the full amount in demand which includes late fees and attorney fees.

So, not only did this HOA fail to reshingle/repair roofs before the serviceable life of the roof expired per HOA doc's, they are passing on the same fraud as Gold Coast Roofing by demanding the home owner pay for the fraud committed by the contractor. Granted the money has to come from somewhere but to admit to being aware of thousands of dollars lost to fraud and not pursue the guilty party is plain wrong. I guess this board believes in the path of least resistance. The board of directors is in place to protect the home owner not tell them "well, we paid it so you have to pay it".

To date, the board of directors refuses to accept my quarterly regular assement payment unless I pay what is now almost $4,000.00 worth of attorney fees and late fees although I have never made a late payment. The roof is only two years old and is missing shingles, not by weather but due to poor workmanship. The association offered a ten year warranty on defect and workmanship but won't even send a contractor to determine if the damage should be covered under warranty.

The Law Firm of Sachs, Sax & Klein are the most crooked in the business. They represent the association and are fully aware that there is a misappropriation of funds by applying a regular assessment to a special assessment but continue to try and enforce such. I guess the state needs to do more to crack down on these associations and their Nazi ways.
