Blackberry - Blackberry curve 8320

I purchased 2 Blackberry 8320 for Christmas gifts. One is defective. It drains the battery in just a few hours without a sim card in the device and without using any applications. I have continuously tried to contact the compnay since the day after Christmas. They will not respond. I am filing a complaint with the better Business Bureau.
