Unethical illegal telemarketing billing and fraudulent practices

I am aware of the many complaints filed on the corporation known as Trilegiant, I feel my complaint does differ a little bit compared to everyone else and proves that Trilegiant is using Unethical and illegal practices when doing their marketing. I have a store card I use for car repairs, when I charge it I pay it off so I can build my credit easily.

After not using the card for over 3 months I was shocked to find 2 memberships (Everyday Values and Healthsaver) charged to my credit card. I immediately called the credit card company asking what happened and why was this charged. Under the Fair Credit Billing Act I wrote the credit card disputing the charges saying they were UNAUTHORIZED.

The credit card company told me to call both HealthSaver and Everyday Values asking for cancellation numbers because they were actually added back 3 months ago. After spending 5 hours on the phone I talked to both Everyday Values and Healthsaver... Only to find out they could not retrieve any of my account information and had to revert to the Privacy ID # to find out the TRUTH.

Both services were not made in MY name or sent to MY address but to some guy somewhere in Spokane who happens to have the same last name as me (first name is Jack)... Assuming that this guy was related to me somehow. The stupid question they asked me is "do you know him?" I said no... Then the CSA asked "are you sure you are not married to him?"... I looked at my husband (who's name is Herman) to double check and said "No, I'm pretty sure my husband's name isn't Jack"... I asked them "how could this have happened?" Healthsaver's supervisor divulged that it was made from Outbound telemarketing calls.

The pure ironic part is that I am an Telemarketer and the stupid part is they should of been aware that I know the Telemarketing Rules and what rules they have broken. Not wanting to talk any further I got the cancellation numbers, disconnected the conversations and gave it to my credit card company thinking the incident was over. How wrong I was.

About a month later I received another statement with various finance charges and the Healthsaver still being charged. Very furious, I called again and asked them "what the hell is going on?" the CSA (who wasn't that bright) could not find the account under my name (in which I told her BEFORE that it wasn't made in my name) but surprise surprise to no avail was still under our friend Jack's name.

The real stupid part is that this took about 30 minutes to find. She then asked me "Are you sure you are not married to jack?"... Once again I looked at my husband to double check this and said "Nope don't think so"... Then she went on asking "are you sure you are not living and 'so-so' address in spokane washington?"... I looked at my address and said "Nope don't live there."... I then stated that I have a cancellation number and this should of been cancelled more than a month ago. They then issued another cancellation and I thought it was the end of my nightmare. BUT IT WASN'T!!!

A month later I received my credit card statement saying that I owe them almost 22 dollars in finance charges. I got my response back from my credit card saying I authorized these charges. Iam in dispute once again by issuing YET another letter under the Fair Credit Billing Act.

I never recieved any of these telemarketing calls... Therefor I did not authorize them. Under the Telemarketing sales rules when using "pre-acquired" account information the telemarketer must 1) obtain at least the last four digits of the account number and 2) make an obtain a recording of the entire telemarketing transaction. I plan on calling both Everyday Values and Healthsaver and request the recordings of these so-called conversations... Because "The Rule also requires that audiorecorded oral authorization be made available upon request to the customer"... Both Everyday Values and Healthsaver are aware of their own practices my credit card company refuses to call this unauthorized use, I never received any of these calls (obviously) and to make it worse the crappy services were sent to the WRONG person making him charge my own personal account without any verification (or he is a very good guesser with my account).

If this could be done I'm totally afraid of the other credit and store cards that I own. I maintain a very good credit score and intend to keep it that way but I refuse to pay finance charges to services I never received or intend on getting. The Telemarketer called the WRONG person who bears no relation to me.

AS a telemarketer I had to MISS work to take care of this crap which costs me money. My time is money and being a telemarketer I always follow the rules. The resolution I am seeking is that I want all the finance charges, late charges and the time I lost from work to be resolved... I also want Trilegiant to issue a letter explaining their wrongdoing and shut these deceptive and illegal practices down. Basically I would be happy to see Trilegiant in the fetal position sucking their own thumbs.
