My father in law passed away causing my fiance and to miss work and spend money on travel/hotel. We told our landlord that we would not be able to pay rent the fallowing month for August therefore we will be moving out and would be out by the 1st. She said she understood and everything and told us where to leave the keys. Our Lease states that we must give 30 day notice which we did not do given the situation but it also states Landlord cannot keep security deposit for any type of rent payment. It also says landlord has 10 days to return security deposit or a written letter that accounts for each dollar kept used for damages to property. (House in perfect condition when we left.) She failed to let us know within the 10 days what was going on with our security deposit and she ignored us for weeks when we kept calling/texting to figure out what was going on with the money. We both broke the lease but if we could have given proper notice we would have. Therefor i believe we are entitled to at least half if not all of our security deposit back of $995.00
