I had an opportunity to see this lawyer in action. We had three cases, in Anne Arundel County in which he filed against 2 companies, 1 Builder, and 1 Bank. He failed to include the Settlement Company who was part of the scam, and predatory lending. Worse than that, he got us involved in cases, and then decided to sell us out to the opposing parties, by not filing answers to complaints and/or motions, when they needed to be filed.By not responding to these things, a judge is able to enter an order by default. This happened to us.in addition, he did not follow the court's procedure when he filed the 2 complaints in our behalf. He also represented us in a foreclosure action with the same bank, in which he helped them to obtain a sale by failing to pay $10.00 to enter his appearance, and later it would allow for ratification to take place. He simply stopped answering the motions, and helped the opposing party to get the ratification. My husband and I were left mid way into the proceedings to defend ourselves, without council, and when the judge denied our requests to stay the sale, dismiss, and exceptions to ratification, the judge cited that the responses were not filed on time, and/or were lacking disposition and supporting documentation.
In the case against the builder, he won mediation, but when given the scheduling order, failed to follow it and meet the deadlines. He caused the case to be dismissed. I had to represent myself and request a hearing to reconsider which is currently pending. The outcome is unknown at this time. Had I not filed this request the case would still be dismissed. Last but not least, he did not file any answer to a counter claim that involves 9 counts each asking for a "summary judgement", in the amount of $481,000.00 dollars. You can imagin how I feel. This is currently sitting in a judges chambers with no defense, despite the fact I don't know all of the particulars, and was never served this counter suit. Clay Schramm read this to me over the phone, before deciding not to answer it, but promised he would answer the counter claim.
Long Short... He aided and assisted injustice to be furthered, and the courts used his incompendence to favor the opposing parties. We lost our house, and have a lawsuit over our heads. How much worse can it get. Oh... And one last thing... He once left his briefcase at my house prior to a fire during the blizzard. I contacted him immediately when I found it in my home office, to let him know he left it there. I had looked inside because it closly resembled my briefcase. He had several checks from I would guess prospective clients. So I especially thought that would be important to him. Nope... That briefcase sat in my house for approximately 7 months until I took it to him. (Keep in mind we had a fire, but no harm other than smoke to the briefcase). I don't know what happened to those clients, but it tells me he is just not that interested in being a lawyer. I don't know, and I'm at a loss for words really, but I thought it to be important to at least get this story out, so you can make an informed decision, or at least watch out for this to be repeated in your case. I filed an attorney grievance, and they are still investigating the matters.
