After seeing a flyer for windows in the El Paso, Texas area I called the company and arranged to see their representative on March 24. During the presentation of the companies product the representative told me that several customers have paid-off their windows entirely by referrals.
I asked how this was possible and the representative told me Desert King Windows allows referrals from customers. As many as he or she chooses to refer. The representative told me that one of his customers had just paid off his entire bill by referals only.
Considering my entire bill after purchase I figured I needed to refer forty three potential buyers. The representative gave me a Desert King Windows letter stating, "By giving them the name of someone who will allow us to come out and show our windows, we will pay you $100.00 cash for each name, we will also give them $100.00 for taking the time to let us come out. After reading the letter and taking the Desert King Windows representative's word, I decided to purchase eight windows for a total cost of $4229.00 This is how I determined how many potential customers I had to recommend in order to pay for my entire purchase.
A few days after I signed my purchase agreement I received an envelope from Desert King Windows.inside I found a check for $25.00, and a letter on Desert King Windows letter head signed by Trina Linden, Referral Promotions Manager.
The letter stated, "Thank you for choosing Desrt King Windows for your home improvement project. I have enclosed your promotional gift as our way of saying thank you for allowing us to demonstrate our product to you.

Just fill out the enclosed card with someone whom you know that would also allow us to show our windows to them, and we will pay you $100.00.in fact, you're not the only one who benefits; the person you refer us to also get's $100.00! Keep in mind this is whether they buy or not; all they have to do is see one of our wondow demonstations.
You don't have to stop there either. Desert King Windows will pay you $100.00 dollars for as many names as you would like to refer. You can send in as many names as you want, make as much money as you want that's up to you!

I began to gather names of friends, relatives, and co-workers. I submitted nine names and was told they had only made contact with five of my referrals and only paid me for five referrals.
I now have a $3,500.00 /- bill I must pay out of my own pocket that I wouldn't have committed too if this referral pitch wasn't a factor. I made the purchase believing what the nice-man was telling as he presented his product to me.
Are there any legal actions I can take against such horrid false business practices? Please advise.
