The following is a copy of my last resort to collect money owed me by DirecPath:

To Whom it may concern,
On 1 April my DirecPath service was disconnected. I was told it was due to an upgrade and that a technician would have to be sent to replace the cable box. The technician came but could not do anything due to something between Direct TV and DirecPath. He requested I call DirecPath to have them resolve the situation. While still without service, I called the outsourced customer service department and things became so frustrating that I canceled both my cable and internet and signed up for Comcast. When I originally called due to the no service issue I also made a payment of $192.70 because I thought I owed for two months (see enclosed bank statement). I was so frustrated that I canceled my service, I asked for a refund of the money I just paid. This request fell on deaf ears.

I called numerous times to request my money back and requested each time for someone from billing to return my call. I never received any sort of response. So I contacted the Better Business Bureau to mediate. After a year and constant stalling by DirecPath, the BBB stated they had to close the case due to inability to mediate a solution.

The entire correspondence with DirecPath via the BBB is enclosed. I have also enclosed all the bank statements showing the money I paid to DirecPath.in the transcript, DirecPath states that the payment of $124.78 that I made on 2 February paid my service through 3 April (see transcript date 16 March). The second enclosed bank statement shows my payment for $192.70 made on 2 April and cleared my bank on 6 April. DirecPath states my cancelation date was 7 April and there was no service at all for the days of 1-7 April. Therefore, according to DirecPath, I was paid up through 3 April with their receipt of $124.78 and my service was canceled 7 April which means that I should receive back any money I paid to DirecPath after that date. I thought I was only due back $85.90 for the month of April. However, according to DirecPath’s own words in the transcript dated 16 March I am due back the entire $192.70 because the $124.78 paid my account current through 3 April.
This entire situation has been frustrating and saddening. DirecPath is more concerned with how they will be rated by the BBB than they are about taking care of customers. I would like this situation resolved – I want the money DirecPath owes me. It should have and could have been resolved a year ago. At the very least, I want all of those affected by this company and all of those who might be able to affect change to be aware of DirecPath’s practices so that this does not happen to anyone else. Fortunately, my building, Metropolis opened up service to Comcast otherwise I would have had no choice at all. Hopefully this letter will help convince other associations to do the same.
