This is what has happened to a member of my family.in December My Mom and sister had gotten into a really bad place with the mortgage. My sister had a good government job for over ten years. Downsizing happened and she was unexpectedly laid off/let go. The family home went into default on the mortgage at that time with another bank.
To prevent foreclosure, the family was recommended to a place that promised to solve the problem. A title and settlement company named Pinnacle Title & Escrow did the work. They signed the new mortgage up with a company called Eweb Funding Group. Eweb later sold it to their sister company KH Funding Company. My naive little sister was told to date and sign for my mother as "her attorney in fact" and then sign her own name below. Mom was unable to sign being sick. Two packages were put before my little sister. Also the family had just gotten Mom out of a nursing home where she'd been abused.
She was placed there for rehab after her strokes, but never got to finish because of the abuse. I borrowed the loan documents, I got someone to explain the new loan to me, that under duress and predatory circumstances I believe my little sister signed unawares. They were appalled, speechless and shocked.in detail they told me that KH Funding Company & Eweb Funding Group had overcharged on settlement fees. Their were 3 truth in Lending statements, one which said the adjustable rate of 11% would go to 12% within 6 months. They failed to tell my little sister that when our Mom died (which she did in 2008) that the loan would be on her shoulders.
That in fact by my little sister signing "as her attorney in fact" it was already her loan from that very moment! On the income sheet, no income for my little sister or Mom is listed! KH Funding Company failed to file the certificate of satisfaction concerning proof that the first loan was paid off. So a default is on my little sisters credit report, which in turn prevented her from gaining any hopes of a real job, earning a salary in order to start paying on this loan in the first place! Which I believe they did on purpose. They also paid off another family members debt that did not belong to my mom or my little sister and that other sister was not included on this loan. Just recently using free legal aide to keep the home 2 family members still live in.
Me and 2 other siblings are about to redo a new loan with KH Funding Company. Why? Well unless we find other victims that Eweb Funding Group & KH Funding Company has done this too. Our chances of winning a personal battle with them is ify at best! The private attorney interested in this case has said, he would like to do a class law action suit, but we need other victims. The chances would be greater of bringing these companies down! He's looking for other Homeowners that may be trapped in a predatory loan with KH Funding Company, have already lost their home, or in the process of being foreclosed upon by KH Funding Company & Eweb Funding Group. These predators know they are guilty because my siblings and I refused their last offer.
We said no and were still going to sue despite the odds. Then out of the blue, KH Funding Company sent our free legal aide lawyer another offer. Which is further proof to the rest of the family, that they know they are guilty and can be sued on many charges. Much of which I can't state here. After much debating the family has agreed. Right now nothing has been signed, but I am uncertain and for justice, I personally want to sue these evil predators. To once again be in a place where these predators may gain the upper hand, over the family home? Is not a bright idea to me at all? If other former victims can be found its vital you come forward. That is our only chance. My little sister has had it rough dealing with this mess. But she was never alone, yet we could not undo what they have done to her emotionally. As well as her battle with breast cancer.
I personally do not want or think we should agree to any offer. But my little sister desires to stay in the family home. Because I love her I'm willing to help pay their new offer. But we have time before anything is signed on the new deal. Our situation does not need sympathetic consumers to go complain to these companies. We need former victims that were hurt by these predators. No one knows I'm doing this, but I am determined to get justice. These predators tactics caused a lot of stress which contributed to our mom's death! On top of that, I just want them stopped. So that they can never do this to anyone ever again.
If you ever held a mortgage with KH Funding Company or EWEB Funding Group (really they are one in the same) please come forward. Even if you already lost your home to them, the private attorney told me, these homeoners would still have a right to be in on the class law action suit against KH and Eweb. I can put you intouch with a private attorney, that along with his colleagues are eager to put these thieves in jail!
