Refuses to collect $60,000.00 in child support arrears from a physician

UIFSA laws state that a ruling order is the enforceable order until it is legally modified.

I presented to the Fayette County Child Support Enforcement Office in September with an order that was established in 2004 in Tennessee. The father was 12 month and $34,800.00 in arrears. He was over $11,000.00 in court ordered medical arrears. He exceeded federal standards for conviction. An interstate case should have been opened immediately. It was not.

I poresented with the ruling order and it should have been enforced with the full force of the Fayette County Attorneys Office and federal law.instead it was filed away due to pending court action.

In December that office enforced an order in effect for less than a month that had pending court action. That order reduced the children's support by 75%. I return in September almost 12 months later and $12,000.00 in legal fees, bankrupt, and with our home in foreclosure. I present a certified copy of the original ruling order reinstating the child support. That order should have been aggressively enforced.By now the father was over $60,000.00 in arrears.

I request 3 separate times that they open an interstate case. I complete the UIFSA packet and drop it off to them. I receive a letter from Commisioner Veno stating that I have been issued a UIFSA requesting enforcement of my order. 18 days later I receive an email form the County attorney's office stating that they will not be requesting enforcement of my order due to "pending court action".

That office will enforce a new order that is in favor of the parent in intentional arreas while there is "pending court action", they will not enforce an established existing order with arrears that will benefit the children. 2 months and 5 days later they continue to refuse to enforce an existing court order reinstating the original oredr that I presented with in September due to pending court action.

At what point will they enforce a ruling court order and collect the financial support that my children are entitled to? Their father has evaded his child support for over a year with the assistance of the Fayette County Child Support Enforcement office. He presently owes over $60,000.00 in arrears and over $16,000.00 in medical. He receives $9,876.00 per month. He is a physician with a lawyer. I depended on the Fayette County Child Support Enforcement Office to collect the court ordered child support that my children are entitled to.
An order is an order. It is to be enforced until it is changed. It is that simple.
