In the beginning, Hearing all the tales from other Fathers, I knew I was in for a bad ride from the get. So I thought I would start this off by educating myself so I would not go to the 1st hearing as a fool. So I went to the public Library to see if there were any books for the rights of a Father in this situation. Well, after an hour searching through what they had, I come to find a little tiny section in one of the 15 books I found that mentioned the Fathers rights. It Said: Forget it. That's right Forget it! The woman will win most of what needs to be in the Court Room.
At this point I went to the Librarian and ask her if there was any book that will assist me. Here is what she said So, you want a book on how not to pay child support I can't mention the words I told her before walking out of the Library.
That was back in 1993. I am sure some stuff was printed since but this incident was worth mentioning.
After the Court case, I come to find that I am asked to pay for money she took from Social Service That I had no Idea she was getting until that day. Now I leave this Court owing 7 grand on top of the weekly payments now applied to my child support. I didn't make a fuss because I did not want her in jail, after all, she is their Mom.
Well, by the year I paid all this off. I asked the Child Support Agency each year from 200 to 2007 to send me their review of what I owe them. They did and each year was ZERO. $00.00. That's right, the Arrear totaled Zero each year.
Then, low and behold, I get a letter from them that I still owe the 7 grand, with interest. I had every piece of paper to fax to every single number under the sun in order to get them to re-check this and find that it was paid in full by the year 2000. No one was of assistance. Then I get letters stating this will affect my credit report. Then more threats until I finally sent a letter to the Governors office with all the proof I had that this was a false statement for the 7 grand.
Only after this was done, did I get a letter from them stating that 7 grand was satisfied. No saying any apology for this and clearing up this statement, but a letter that stated it was satisfied. Then it goes on my record as satisfied, not taken off and cleared like the court judgment stated back then, so I had to fight them again, and again, nothing was done to correct this.
After this was done, I lost my job and for the 1st time in 10 years I had no money to pay child support. So I again told them I was in another state (North Carolina) they did not offer me any Unemployment and neither would NY state so I was at a loss to pay. That can be done The answer was Nothing, you have to pay the support order I asked if this could be lowered so the accumulation would no be so great until get back to work. No, that would be a lower weekly but the rest would just accumulate into the arrears anyway. So what's to do? It just added up and finally I went back to work and right away started paying the weekly.
At this time, they started sending me threats again for the arrears like I all of a sudden had all this money. I Didn't.in fact I even owed more that this child support. So, I had to go to NY for a Court appearance to settle on what was accumulated from all this. Ok, I did settle, the Courts stated the new weekly will start on June 12th and I had to pay for a weekly and some for the arrears that I agreed upon. Well you would think this is ok, but it is not.
I come to find that before I head back to N.C. I need to speak to someone at the Ronkonkoma office and they will get me all the paperwork I asked for that stated what was achieved in that Court Room. But I had to wait until the next day because they had no paperwork from the courts. So I went the next day, still, no paperwork from the courts. They said maybe the next day. I told them I was up from N.C. And had to be back for Job interviews but that made no difference.
I was then told to call them in a few days but I was only given a fax number, not a person's number. I took it and then waited for week for them to either call me or send the papers.
Well, no papers after 7 days. I faxed them 3 days in a row, finally got some one to get back to me. Then I was told to wait 5 days for the papers and also wait for 20 days for the correct amounts agreed on in the Court to get applied. Until then, keep paying the old amounts.
I told them the Courts stated I need to start the new payments on the 12 and if 3 payments are late, further actions will be taken; Now, I am already 3 week waiting for YOU Child Support to get your act together. They would not agree with me and just kept on saying to keep paying until this gets changed.
So I did. Now, instead of the payments (2 of them) Being applied toward the weeks we are settling on, they took all of it, applied it all to the arrears and I am now back where I started, 2 weeks behind. What else can me done, I hate to ask!
I have more, lots more but that's all I want to mention for now. But if you think there is more to this story, you're wrong. I have a room filled with all the paperwork I ever had to prove what I am saying. I know I was not treated well and without respect despite my efforts to prove them wrong.
