Dr. Mapes made a disclosure of confidential health care information during the course of my child custody evaluation.in Court Dr. Mapes stated:
DR. MAPES: I do not recall doing that (related to an unlawful release of protected health information).
There is no doubt that Dr. Mapes made this unlawful release. While he may have had selective recall during the hearing, the fact is that he made an unlawfully release of confidential health care information without my written authorization and outside of the authority granted him under his appointment as a child custody evaluator. This is not a trivial or hyper-technical matter.
While Dr. Mapes, informed the Court that he did not recall releasing this information, the United States Department of Health and Human Service, Office of Civil Rights found that he released my confidential information. Here is what the United Stated Department of Civil Rights said about the matter:
OCR concluded that Dr. Mapes's (sic) disclosure of the fact that he had received records from (name withheld) was not required by law, not ordered by the court, and was not covered by another provision of 45 CFR 164.512 [known as the Privacy Act].
