Never sent the phone, and wont give my money back

Cricket sent the phone to the wrong address, but not to me. I tracked it on the fedex web site and it went back to them. Now they are saying it wasnt returned within 90 days (they had it back in 5 days) and wont give me my mony back. Thieves
