Unlawfully withdrew 24.95 out of my account causing overdraft fee of 33.00

I don't know how they got my account number but I saw a transaction for 24.95 on th 19th of Feb. Which overdrew my account then I was assesed a 33.00 overdraft charge. My bank told me to call them, but they refuse to be liable for the overdraft charge. What can I do??? Please help..
