Hello my name is Kimberley M. Davison, I am one of about 100 people who feel they have been taken advantage of by their loan company. My loan was with First Franklin Financial and because I fell into hard times and filed bankruptcy it was was sold to Litton Loan Servicing Company. As you can see from the documents that I have attached, I filed bankruptcy in August and my bankruptcy was discharged on November 17. While I was in bankruptcy my first loan like a said was sold to Litton and my second loan was with Countrywide Financial. I called Countrywide and was informed by them that they could not help me until my discharge was filed and every time I called Litton they never wanted to help me all they wanted to know was how much we could pay. Once the discharge was received my husband contacted Litton to try to see if we qualified for a loan modification, and we were first told that Litton did not do Loan Modification and we needed to contact FHA "Hud" and they would be able to help us. Well my husband contacted them and they told him they were not doing loan modifications either, they were doing loan counseling and could not help us either. We need to contact our mortgage company for this service. Okay well since I filed bankruptcy I assumed that once my discharge was done my loan would be sent back to First Franklin who was our mortgage company before they sold our loan to Litton, and since Litton had already told us the didn't provide this service. I contacted First Franklin who told me that could not help me because my loan was sold to Litton. Now I call Litton back and they proceed to get my information and tell me that we don't qualify for a loan modification. Now recently I have been inquiring with other people who have gotten loan modifications and they have all told me that there is no way that the could of disqualified me over the phone they should of sent me a loan modification package to gather all my information there is a formula that is used to determine if you qualify or not. Now I have come to terms that one of two things are going to happen to my house. 1. It will be foreclosed on or 2. My house is currently with a realtor and we are trying to get it short sold. My question for you is how can a house that we currently owe $440,000.00 be now entered into a short sale for $180,000.00 and no one would even talk to us about a loan modification. My next question is how can Litton Financial state in the Declaration of Compliance which I have been made to understand needs to be filed and sent to me at least 30 days prior to the Notice of Default state that "The Mortgagee, beneficiary or authorized agent was not required to comply with Cal. Civ. Code Section 2923.5" because "The Borrower has filed bankruptcy, and the proceedings have not yet been finalized." When I was not in foreclosure at the time of my bankruptcy. We stopped making payments as of October 1, I filed bankruptcy in August, of my bankruptcy was discharged as of November 17, and when this Declaration was done as of January 23 I was no longer in bankruptcy. Lastly, I have been told that once they notify you with the Declaration they have to wait 30 days before they can file the Notice of Default well my Notice of Default was filed on February 2 which has also been attached for your review. At this time I feel like what Litton is doing is illegal and they are not a mortgage company and from I have also been told a collection company can not foreclose on a home they have to represent a mortgage company and I am not sure who that is. I also feel like I am being forced to short sale my house because no one was willing to even try to work with me for a loan modification. I have attached information from a class action lawsuit, that I found on line that was filed against Litton Financial in 2008 for other fraudulent things that they have done. I don't understand why another class action lawsuit with different causes of actions can't be filed against them. I have also attached 62 pages of complaints that have been sent to the complaint board, consumer affairs for different things that this loan servicing company has done to other people that would like something done to them as well. People are losing there homes each and everyday and it seems like we got into this mess because of bad loans, but now we are losing our homes because of bad loan companies not doing what they are suppose to do to stop foreclosures and help the consumer.
