Andrea Martinez Ripped off our downpayment for services not rendered

21st Century Legal Services contacted my wife during foreclosure of my home of 12 yrs. We went through a hardship last year in March which involved an accident with one of three boys in our family.

To make a long story short we couldn't make our mortgage payments. We have been trying to work with our loan servicer but to no agreement with their terms which was in short going to extend our situation by foreclosing in three to five years, so our only option was a Bankruptcy Chapter 13.

Our date of sale of our home was on 1/30.21st Century contacted my wife around the 8th of the same month. This is what Didi Hayes said to my wife when she contacted her representing 21st Century Legal Services.

"21st Century is a well Known real estate company through out the country, referring to Century 21 real estate. We will modify your loan to a 3% interest rate 30 year locked in, but this must be done quickly since we have a couple of weeks before your house is sold, but we need to receive a down-payment of $1700.00. For a total of 3,500.00."

My wife responded by saying that the house is about to be sold on the 30th. Didi Hayes said "no problem we can do a package that they will not resist and if this doesn't work we will go forward with a BK 13 to save your home".

Since the loan modification was the same that the loan servicer was offering us for month's we did not accept 21st century offer on the weeks before the home sale date.

We asked them to go forward with the Bk13. Their answer was that they did not do BK13, but they had somebody that did and it was a representative of the firm, a paralegal, his name is Michael Bates.

There is nothing Legal about 21st Century Legal Services. Representative contacted me a day before our home was to go up for sale, and this was done after day's of trying to get a hold of them, since they were not responding neither were they calling back after leaving them messages that our home was up for sale in a two days.

Michael wanted an additional $600.00 to help me file four sheets of paper, which I did pay since I was desperate, but not knowing at the time that without a certificate for counseling included your case will be dismissed in court if filed without the certificate.

For those of you that don't know, before filling you need to have a certificate from a reputable financial counseling service or else the BK will get dismissed in the courts.

Overall it may look like this company is helping you out but in the long run you will find out that it's smoke and mirrors.

Bottom line is that they want your money and since the checks that you hand them when the notary comes to your home are pre-dated, you will see that they will do anything to cash them before you realize that you have been scammed. Andrea Martinez is the brains behind this elaborate scam and I hope to god someone can stop her from ripping people off of their hard earned money.

Andrea Martinez stopped taking our calls and further threatened us by getting a hold of our mortgage servicer and telling them that they are no longer representing us and to fully proceed with the foreclosure after our Bankruptcy is dismissed from lack of the counseling certificate.

They just started up a web site that they didn't have a month ago. Please stop them before they abuse any more families, since this is who they are hurting.
