Sign Posted "Tenant Parking Only violators will be towed". Does not state "tenant Permit parking only". Sign altered to include the contact phone number then covers up "violators will", so the sign now reads "Tenant Parking Only & be towed."
My finance & I meet @ the church with to speak with the priest about our up coming wedding. I she had dropped our dog off @ my house before she went to work. The it was -5 degrees outside with a -15 wind chill. I let her take my mothers car over to her apartment since it was already warmed up and had seat warmers while I to her car, the one with the permit in the back window. Back over to my house to pick up our dog and bring it back to her.
I then showed up about 30 Minutes later and took the dog in, got warmed up used the restroom, said good night. This only took me about a half an hour all together. Come out cars gone. Look around saw many empty spots just as many as I saw when I arrived. Hallmark Rentals Agent Bells towing removed the car under the emergency clause of Indiana Code 9-22-16 subsection b., this allows for no wait time. But does still require to report they have removed the car after taking it.
I have no doubt that they have a sign posted, I have no doubt they believe the have the right to do it. They are using this as a reason not to provide more parking for the additional Building they put up this summer. They added 16 units or 20 units, only 3 additional spaces then posted the sign. They then denied tenants additional parking permits for married couples and two bed room apartments, so they didn't have to register there over occupancy as per city municipal code requiring 112% per occupancy/bed. This law was to be used only when the parking lot is full and there is an unauthorized car on the lot... The lot was not full and did not block open parking or handy cap parking which they only have 2 spots for the higher number of occupants and not even one on the side of the new building only a ramp...
But I digress, I talked to the apartment complex they said they aren't liable for the removal of the car, and began asking for my address I gave them my address and phone email, they said no whats the address of your apartment I can show you in your contract, I said I'm not a tenant I live in the city of Bloomington... She asked for my finance's address and name, I said this is my property and I do not have anything to do with your contract with her yet. She asked again. I said here's my information. So I wrote to the tow company, they said there will be no refund. They can tow there any time. I asked for the report they are required to file... Nothing, I said well I want the name of the officer that authorized it, "We don't have to report it".
I pick the car up that night after being told that I had to pay $120 cash to get it back. I did, having to wait on him and getting the money from the bank at 1 am he said you can get your receipt in the morning. I emailed him he sent me the receipt, but he called me back to ask when "kind of a car did you get towed where was that at?"..."?" This from the same guy that I paid. Hmm I realized that he didn't even ask me for id I didn't sign a release?
Then I found the part about having to report the car with in 72 hours of release & having to check ID with registration. They didn't even know the plate number/vin/name or anything about the car... They just made up the receipt based on me telling them my name and that they had taken my money. The car is my mothers and not mine. I'm not on her title or registration... Thank goodness the car wasn't stolen... Who's to say they they couldn't just pick cars at random put them in a lot and then say that they were parked wrong place... They said a resident reported it not the landlord.
Isn't this why police or government agency required to look over and file an abandoned vehicle in report is not an emergency I was not parked on the side walk they do not have numbered spots nor do they have visitors parking. I say not only did the tow service towed under false pretenses but also did so to make money and not because it was to help the residence, which one ended up having to be exposed to the elements to retrieve the car 2 twice to the one time someone had to walk from a parking spot 2 spaces down.
My right protection against unjustified seizure of property and extorted for profit I know there were others in this town enough that a case could be built for racketeering, they don't charge the apartments and tell them that there is no liability for them, and will place signs for them rather than providing or planning for additional required parking. This is Wrong and the only Reason I say this is Because I was planning on moving into the complex but after I read that I wouldn't be able to park there even when we get married... That I will have to walk a quarter mile every day to get home, something was wrong with this picture. The Tow company did not file report, release the car with out proper identification, they never even saw me with the keys. Whats wrong with this picture?
