I bought a painting on ebay Item number: 220271541846 from an Alvin Wood in 2215 East Ross Ave, Phoenix, Arizona 85024 480-720-2284. I sent the painting to Fine Art Experts out on the east coast and they deemed the painting a fake.
I filed a claim with Paypal PP-566-954-364 which was awarded in my favor. They instructed me to FIRST send the painting back to Alvin Wood and then he would refund my money.
Well guess what? Little Alvin has my painting and my $3177 to boot. He has had it since November 1st and hasn't refunded a dime. I called Paypal many times before they finally gave me $2000 of it back due to their protection plan. But I had to call like 8 times before someone even decided to do that.
I then filed complaints with the FTC, San Jose BBB, Omaha Attorney General (as paypal should have never had me send a fraudulent painting back to it's owner) and the FBI Internet Fraud Division.
Guess what I still haven't seen a dime of the $1177 still owed to me. The FBI did leave a voice mail on Alvin's phone. Alvin said he was going to take care of it. That was 3 weeks ago. He's whining that his paypal account is blocked. The FBI agent actually acted like I was the bad guy for blocking his paypal and ebay account. I told him that PAYPAL does that on their own.
Oh yea Paypal and the Phoenix police are trying to tell me this is a civil case and not criminal. How can it NOT be criminal as the guy flat outright stole $3177 from me by not sending me my money back when the painting was returned. The amount makes it Felony Theft as well. Also it would be a Fine Art Fraud as well beings he sold the painting as an "ORIGINAL GUSTAVE MUSS-ARNOLT.
What can I do here to get this man arrested and charged? The FBI isn't going to do anything. The Phoenix Police already stated they weren't going to do anything.
I'm I screwed out of the money and is this little weasel going to get to sell that painting all over again?
