Violated Civil Rights and continued Civil harassment Frank Michael Pacheco

Most of the following was prepared by a friend who witnessed this abusive situation.

In May my friend Jacquelyn and her three children (Tanner 18, Kameron 14 and Rebecca 12) rented two rooms at $600 a month from her friend of five years Frank Michael Pacheco 2518 Wagner Heights Road Stockton, California, 95209 residence.

Ms. Archambault, her three children, and three cats who rented two bedrooms from Mr. Pacheco also had use of the common area of the home along with kitchen and phone privileges.

Some time in June of Ms. Archambault informed me that Mr. Pacheco had become very hostile toward her and her children. On numerous occasions Mr. Pacheco threatened Ms. Archambault and her children when she refused to agree to new conditions of their rental agreement. Mr. Pacheco later poked a hole (by some unknown device) in one of Ms. Archambault's cats (Baby). Soon thereafter Ms. Archambault and I went out on numerous afternoons apartment hunting.

On or about June 21 Ms. Archambault filed a Civil Restraining order in San Joaquin Superior Court against Mr. Pacheco for sexual and other harassment.

On June 27 Mr. Pacheco threatens to kill Ms. Arhcambault's children. Specifically stating that he was going to put Rebecca in front of a Mexican Mafia firing squad and blow her head off.in imminent danger for her life Rebecca called her grandfather in the Los Angeles area and informed him of what Mr. Pacheco had said.in turn her grandfather called the Stockton Police Department to initiate a welfare check on the residence. Subsequently, Mr. Pacheco was arrested for criminal threats. At this time the Stockton Police Officers informed Ms. Arhcambault that they could get her a (ERO) Domestic Violence restraining order. Ms. Archambault informed the Stockton Police Officers that she was anticipating picking up one already filed at the courthouse the next day.

On June 28, Ms Arhcambault picked up the civil restraining order signed June 22 and had Mr. Pacheco served in jail. The civil restraining order clearly stated that Mr. Pacheco was not to harass, threaten, stalk, and stay 100 yards away from Ms. Archambault and her three children and turn in his fire arms (which he has still not done).

On or about June 30 Ms. Archambault's two youngest children went to stay with their grandfather. Her oldest child stayed with Ms. Archambault until July 12.

During this time Ms. Archambault was seeking a new residence. However, in the meantime she was served with an Unlawful Retainer to appear in court on August 1.

On or about July 15 I went to stay with Ms. Arhcambault as a guest. Ms. Arhcambault was pretty sure she had found an apartment to move into and requested my assistance with her move. However, as the day progressed Ms. Arhcambault found out that she did not get the apartment because Mr. Pacheco intervened with Ms. Acharmbault's communication with the Ashley Park apartment manager and he gave her a bad reference.

On July 18 Ms. Archambault went to court in regards to the civil restraining order.
At this time the judge stated that Mr. Pacheco could briefly enter the residence and retrieve some files and clothes. Mr. Pacheco was not, however, to inventory the residence nor was he to enter into Ms. Archambault's rooms which he did.

On July 20 after Mr. Pacheco's civil standby Ms. Archambault and I went to the residence and took inventory of the articles that were missing. Mr. Pacheco did not take his files; however, took many other items. Furthermore, Mr. Pacheco disconnected the central heat and air in the residence and moved his car that was parked in the driveway into the garage where Ms. Archambault had been parking her vehicle for safety reasons.

On July 20 not wanting to be responsible or blamed for missing property Ms. Archambault called the Stockton Police Department to make a report. The Stockton Police Department would not take a report.

On July 22 Ms. Archambault went back to court in regard to the civil restraining order. Against Ms. Archambault's wishes Judge Saiers removed the 100 yards distance from the restraining order and moved it to 0 yards. However, the harassment and stalking portion remained in effect.

On July 22 Ms. Archambault retained a copy of the civil standby report at the Stockton Police Station. The report indicated that Mr. Pacheco retrieved one truckload worth of items and one vehicle (the same car he parked in the garage).

On July 23 Ms. Archambault and I at approximately 9:30 A.M. While out running errands noticed writing on Ms. Archambault's tinted window. "F J" with a heart was scribbled on her vehicle. Ms. Archambault informed me that she just had the vehicle washed on July 21 and showed me the receipt. Then Ms. Archambault logically concluded that the reason Mr. Pacheco parked his car in the garage was so he could tamper with hers and know when she was in the home or away.

That same evening Ms. Acharmbault and I invited my ex-brother in law over for a BBQ. At about 7:30 P.M. Mr. Pacheco had his Eighty-year-old father drive by the house while he hid in the back seat. Then after dinner while we were chatting around the table the Stockton Police knocked on the screen door. Stockton Police Officer Padilla (Badge # 1537) and Stockton Police Officer Cook stopped by to tell Ms. Archambault that she needed to close the garage door. I asked the Stockton Police Officers if having the garage door open was a crime and they replied, "No." However, they were not going to leave until the garage door was closed. Next Ms. Archambault went outside and spoke with the officers and closed the garage. Ms. Archambault asked how they knew to come to the home in which officer Padilla stated, "Mr. Pacheco stopped us down the road and told us to stop by." At this time the officers left. However, moments later they drove back by the home at quite a slow rate of speed.

On July 23 Ms. Archambault and I were planning to wash our vehicles when Ms. Archambault had to run a quick errand. While Ms. Archambault was away on her errand and while I was washing my vehicle Stockton Police Officer McNally (Badge #1075) stopped by to inquire about Mr. Pacheco's vehicle which was now back in the drive way. I asked the Stockton Police Officer if it was a crime that the car was in the driveway. Stockton Police Officer McNally stated that it was not; however, she spoke to Stockton Police Officer Swain (badge #1724) and he told he that he pushed the car in the garage on July 20, during the civil standby. At this time I informed Stockton Police Officer McNally that according to the civil standby report written by Stockton Police Officer Swain (Badge #1724) Mr. Pacheco retrieved the vehicle and that he returned the vehicle to the residence after the civil standby which puts him in violation of the restraining order. Secondly, that if the vehicle was put into the garage it should state that in the civil standby report. I then insisted she take a report about Mr. Pacheco's violation of the restraining order. Stockton Police Officer McNally refused and stated that I would have to call it in when Ms. Archambault returned. Furthermore, Stockton Police Officer McNally (Badge #1075) went on to state that the residence belonged to Mr. Pacheco, and he had pictures, and he is going to sue her in civil court and Ms. Archambault needed to move out. At this time I informed Stockton Police Officer McNally (Badge #1075) that the situation was a civil matter and unless she was going to take a report in regard to Frank Pacheco's violation of the restraining order and the central heat and air being disconnect this matter will be taken up in court. Furthermore, that it seemed to me that the Stockton Police Department were disavowing Ms. Archambault's complaints, because when she calls to make reports nothing happens. However, on the other hand, Frank Pacheco calls about the car being parked in the driveway and the police hightail it to the residence. Stockton Police Officer McNally (Badge #1075) informed me again that Frank Pacheco was the property owner and he has the right to know what is going on in his home.

Early afternoon on July 23 Ms. Archambault returned back to the residence. I informed her of Stockton Police Officer McNally's (Badge #1075) visit. Additionally I stated to Ms. Archambault that Stockton Police Officer McNally (Badge #1075) stated that she came by about the car being parked in the drive way (the same car that was retrieved in the police report) and refused to take a report about the writing on her window, disconnection of the central heat and air, and the car being the garage. I also informed Ms. Archambault that Stockton Police Officer McNalley (Badge #1075) stated that she spoke to Stockton Police Officer Swain (Badge #1024) and he told her that he pushed the car into the garage during the civil standby. Both Archambault and I read the civil standby report again and it clearly stated that Pacheco retrieved one truck load worth of items and a car.

At this time Ms. Archambault wanted to make a police report. Next she called the Stockton Police non-emergency number and spoke with dispatch. Dispatch told Ms. Archambault that Frank had been calling there "a lot" about this situation and they would have an officer come out or call. A good while later Stockton Police Sergeant Reynosa (Badge #1053) called Ms. Archambault on her cell phone. Ms. Arhcambault explained to Stockton Police Sergeant (Badge #1053) that she has in her possession a copy of the civil standby report.in the report it clearly states that Frank Pacheco retrieved his vehicle; however, that same vehicle was still on the premises, and if it was still on the premises why does it state in the report that the car was retrieved in the report. Furthermore; if Frank Pacheco took the car he then would have had to return sometime after the civil standby to place it in the garage. Officer Swain swears to Ms. Archambault that Frank did not enter her room or disconnect the central heat and air while he was there. If not then; then when? We access before Ms. Archambault returned home later that afternoon.

At this time I can't say what Stockton Police Sergeant Reynosa (Badge #1053) was saying to Ms. Archambault; however, it became certain that again the Stockton Police Department was not going to take a report.

Ms. Arhcambault; then in tears, handed the phone to me and I spoke with Stockton Police Sergeant Reynosa (Badge #1053) who among other things stated, "Police reports are neither here nor there." Ms. Archambault was upset because she knew the Police were not going to help her. After I stated to Reynosa that, "You can't protect one without protecting the other, " Stockton Police Sergeant Reynosa (Badge #1053) stated, "I will be right over." Later we accessed to oppress the both of us.

Stockton Police Sergeant Reynosa (Badge #1053) and Stockton Police Officer Brown (Badge #1223) arrived roughly between the hours of 2:00 P.M. And 4:00 P.M. And stayed for approximately 45 minutes. During this conversation and among other things Stockton Police Sergeant Reynosa (Badge #1053) and Stockton Police Officer Brown (Badge #1223) repeatedly stated over and over again to Ms. Archambault that she needed to move out and as long as she stated in this [Frank Pacheco's] house they were not going to protect her. Furthermore, they interrogated her past and indicated that because she was in this house that she must be a troublemaker because she complains. At one point Stockton Police Officer Brown (Badge #1223) told Ms. Archambault that she needed to quit school and went on to discuss how life was tough. Furthermore; Officer Brown stated if it were her she would get out and run. Ms. Archambault accessed that Officer Brown must be used to running away from her problems to suggest she do what Brown would do and run.

Additionally, when Stockton Police Sergeant Reynosa (Badge #1053) and I were discussing Stockton Police Officer Swain's (Badge #1742) civil standby report; Stockton Police Sergeant Reynosa (Badge # 1724) grabbed the report out of my hand and wrote on the report, "Took items totaling this amount, " and drew a line connecting it to the line where the report states, "Pacheco retrieved one car and one pick up truck worth of items." Then Reynosa tossed the report on the counter and stated, "Now this is an official report, " (Badge #1058) and asked us if there was any thing else. The two officers left and did not take a report.

On July 25 I called the Stockton Police Internal Affairs Department in regards to the aforementioned incidents. I informed them that the department was refusing to take police reports and about Stockton Police Sergeant Reynosa changing an official report. At this time Internal Affairs connected me with the watch commander Stockton Police Sergeant (acting Lieutenant) Zermeno. Later that day he returned my call and subsequently sent to the residence Stockton Police Officers Jon Scofield and Larry Lane to take a police report about Frank Pacheco's civil restraining order violations (Report #0540428).

On the morning of July 28 at approximately 8:45 A.M. Stockton Police Officer Foster, Private Investigator Craig Williams (State License #22553), and Attorney Frank Pacheco entered through the back of 2518 Wagner Heights Road. At this time my friend Ms. Archambault was the legal possessor of the property and I her guest asked the three men to leave and they refused. Upon entering the home, Stockton Police Officer Foster identified himself as a Stockton Police Officer. Standing at the top of the stairs scared to death I stated, "If you are an officer why didn't you knock and the front door?" Foster replied, "I banged at the front door." (Which is not true because I was standing in the hallway approximately 12 feet away from the front door waiting for Ms. Archabault to take me to work).

Archambault went down stairs first and informed Officer Foster that she had a restraining order against Pacheco and that he was to leave. Officer Foster stated he would not stop Pacheco because the 100 yards on the restraining order had been lifted. Then I went down stairs and Williams handed me and Archambault a summons to appear in court for trespassing. Then I informed Foster that the "No Harassment" part was still in effect. Officer Foster did not care. He allowed Pacheco to harass Archambault and myself. Next Archambault informed Officer Foster that Pacheco had filed an UNLAWFUL DETAINER with the court and this matter was to be taken up there. To which Officer Foster stated that he could not make her leave; however, at the same time he was not making Pacheco leave either.

During this entire time Archambault was very upset and repeatedly asked Officer Foster and the others to leave. Officer Foster ignored Archambault and stated, "This is his house, he can do whatever he wants."

On or about this time I asked Archambault to get dressed, because, she was in her nightgown. As she was going up the stairs Officer Foster moved closer to me where I was standing. He looked right at me, moved his hands away from the center of his body and spread his legs and postured his gun. Still looking at me after he postured his gun he placed his hand on the weapon. At this time it became very clear to me that we were being forced to leave and if I did not convince my friend soon to leave something really bad was about to happen.

When Archambault came back downs stairs dressed she stated again that the three men needed to leave. And again Officer Foster stood there thrusting his authority under the, "Color of Law."

Pacheco was making demands on Archambault, among other things he was telling her to move her car out of the garage so he could park his car in there, changed the door locks, took Archambaults house keys. Also, he was taking pictures of Archambault and she asked him to stop but he didn't. He was going through her personal belongings and accused of stealing. At some point Officer Foster left and allowed Pacheco to regain control of his property in which my best friend was legal possessor of at the time.

About two hours later I called and spoke to Stockton Police Sergeant Stansbury. Among other things, he refused to take a report, stated that what happened doesn't exist, and I did not have standing.

Archamabault and I left that morning fearing for our lives and knowing that the Stockton Police department would not protect Archambault and myself from Pacheco.

On September 1, Ms. Archambault and I appeared in small claims court in Stockton California at 1:30P.M. After going over the procedures both Ms. Archambault's case and mine was moved to Superior Court Department 33. On our way to Department 33, Ms. Archambault stopped in the rest room. Unable to stand the smell I informed her that I would meet her by the courtroom. As I was walking down the corridor, low and behold, I see Stockton Police Officer Foster. At this time I greeted him. Then as Ms. Archambault was making her way down the corridor I indicated to her that Stockton Police Officer Foster was there and she should say "hello."

The point here is that both Private Investigator Craig E. Williams and Stockton Police Officer Richard Foster appeared and testified at our small claims court hearing; however, they were not summonsed and there is no record of them being in court at all filed in the paper work.

It has come to my attention in resent days, which might perhaps explain the police, and courts behavior is; 1). Frank Michael Pacheco is an Ex Sacramento Sheriff and now Attorney at Law, 2). Craig E. Williams is an Ex - Stockton Police Officer married to Deputy District Attorney Janet Williams and now Mr. Williams is a Private Investigator. 3). Stockton Police Officer Foster is trying to cover his tracks or the departments.

I think at this time knowing what I know it is very safe to say that Frank Michael Pacheco pays Craig E. Williams $75 dollars an hour. The Stockton Police Department refused to take Ms. Archambault's reports about the incident on July 28 because Craig E. Williams's wife is not going to prosecute her husband or Frank Pacheco because Pacheco employs Williams.

Recently I had filed a complaint with the Dept., of Fair Housing and Employment for the sexual harassment I incurred from being a renter of Mr. Pacheco's. Unfortunately; my children were the only witnesses to the abuse. Although the investigator said my testimony was credible; children are not considered credible and the depts., attorney's would not take the case. She did inform me that I should get an attorney and sue Mr. Pacheco in Civil court for harassment.
