Hello, In about Jan I received a speeding ticket from a police officer in Valley View Tx (Cooke County) for 36 mph in a 25 mph school zone. My speedometer read 30 mph when I first saw him, and all the kids were inside the building by this time. Anyway, I was going to contest this ticket so I had to enter a plea to the judge in open court of not guilty. (This not guilty plea irritated him because he said if you are not guilty why did you get a ticket?) Well, little did I know that the Judge was a guy that I knew from the town grocery store deli, he was also the mayor of Valley View which is a violation of the Texas constitution, he can't hold two offices. Second violation, while entering my plea I noticed he was wasted drunk. Third violation, he can't take my plea or hear my case because I had known him on a personal level for 8 yrs. I also stated that I did not know how to plea to something that was not a crime (traffic tickets are supposed to be civil law) so he entered a plea of not guilty on my behalf, and told me that would note that I had refused to plea, but I had not refused to plea, you can not plea to a civil offense.By the way, he was actually impersonating a judge because he never took or filed his constitutionally required oath of office with the state. (Tx Const. Art 16 sec 1) Anyway he recused himself a few days later and called in an associate judge from a nearby town.
I checked with the state and this alleged judge had not taken the oath and statement either. And according to the legal definition of associate judge, they can only hear appeals and mine was not an appeal. While awaiting a court date I filed numerous Texas open records requests which thay have 10 days to answer, which they failed to do every time in order to stall so I would not have the evidence I needed at trial, and when I filed a motion for more time it was denied because the judge said it was worded wrong. I thought the courts were required to relax the rules when someone who is not an attorney wants to defend themselves. I asked to see the notary log book and was told that they did not keep one. However, I was able to obtain certification from the state that all six of the Town Alderman, the first judge, the associate judge, the cop that stopped me, and the city secretary had no oath or statement filings on record with the state. I had on a City Of Valley View letterhead, signed by the city secretary, that the police cruiser had no required radar maintenance log, and this car had been in their force for 3 1/2 yrs! Court day, I hired my own court reporter which the judge would not allow into the court room. Only when witnesses object can a judge make that decision, but no one objected but the judge. Cost me 125.00 on the spot, to send the reporter back home for nothing.
During the trial the judge refused to allow my evidence in even though I had entered it into the record before the trial as required.
