I worked for Elaine James owner of PBE-Painting By Elaine as an individual administrative contractor.in November she wrote me a paycheck for $600 which bounced. She blamed it on my getting the check into the bank on time. At the time I felt as though it was her responsibility to tell me if a deposit HAD to be made. There were several times she said just get it in when you have the chance, so I had no way of knowing that my check had bounced until I got $101 dollars in non-sufficient fund fees. She made good on the $600 but since it was the first time that had ever happened, I just ate the bank fees & other costs.
Little did I know she habitually writes bad checks.in April she bounced another $600 check to me. Ms. James called me about mid-April to tell me that a check had bounced on her, and to watch out on my bank account. Of course, as a result, her check did bounce. She again made good on the $600, but I received $463 dollars in bank fees. She made a deposit in my account of $220, but refused to pay any more.
I have been trying to serve Ms. James with a summons for small claims court, but so far she has been successful in evading the process servers. If anyone knows anything that would help in serving her, please contact me.
