Dear Billing Dispute Dept:

Please find attached a detailed ACCOUNT HISTORY REPORT (3 pages) from Plaza Family Dental. On Page 1, Paula wrote in her own handwriting that she attempted to resolve this dispute with Care One Credit and spoke with two people at Care One who confirmed that they would fix my account.

The quotation from Paula in her own handwriting is as follows:

Spoke with SHELBY. Said she will fix customer's account. Account WAS NOT ENTERED on a 12-month promotion. Shelby corrected and said she would credit any other problems that occurred with the NON-12 month promotion. On 2/27/06, I spoke with Jennifer at Care One Credit. Said account was credited on 2-6-06.

Well, neither Shelby nor Jennifer fixed my account, for whatever reason.

I have received a confirmation from Paula that although most of the payment plans are a year and a half that a mistake had been made in my monthly payment plan and that Care One Credit had approved my 3-year plan of $70.00 a month with no interest or finance charges, since I could not afford the $190.00 a month/12-month program. This clerical error was made by Care One Credit and two women from Care One Credit confirmed that they would fix this problem.

As you can see from the attached STATEMENT for May 8, the problem has still not been fixed. On April 21 a GE Money Bank Representative contacted me and stated they would send a dispute form. On April 26, Rick Brackis from GE Money Bank contacted me and informed me to not make anymore payments until this dispute has been resolved. I advised Rick Brackis of my previous correspondence with GE Money Bank and Plaza Family Dental and he stated I did not have to make my MAY payment. As my MAY payment has been waived until this dispute can be settled, I have highlighted a chronology of payments made by me.

5 Payments Have Been Made by me, Chris Newcomb, to GE MONEY BANK, per original agreement with Care One Credit of $70.00 a month for approximately 3 years while the problems with my statement continued:

This letter confirms that 5 payments of $70.00 have been made for a Grand Total of $390.00 paid on my principal balance.

The original amount owed was $2,281.00, therefore:

$2,281.00 - 390.00 = $1,891.00 (This should be my current principal account balance as of May statement.)

Account Balance for May Statement reads: $2,644.00.

Disputed claim:

The only thing I signed was a credit application for GE Money Bank at Plaza Family Dental and GE MONEY BANK gave a verbal approval amount for costs of lab fees incurred for my mother's dentures. Since I could not afford the 12-month payment plan of $190.00 a month, an agreement for a plan of $70.00 a month for approximately 3 years was made by Care One Credit with Plaza Family Dental. Plaza Family Dental proceeded to tell me that Care One Credit agreed to allow me to pay $70.00 a month for approximately 3 years with no interest or finance charges.

I approved of this plan with the Receptionist, Rachelle, who approved of the plan through Paula, who both approved this plan from what Care One Credit explained to them by phone of $70.00 a month for approximately 3 years with no interest or finance charges. No promotional plan was discussed. Care One Credit proceeded to issue my monthly statements and for whatever reason, the plan did not go through.

Please find attached a detailed history of payments made and my continual requests to both Plaza Family Dental and GE Money Bank to see this dispute resolved.

Rachelle, Office Assistant for Plaza Family Dental, after the Credit Application had been approved, had informed me that since I could not afford a 12-month payment plan of:

$190.00 a month for 12 months

THAT GE MONEY BANK made arrangements for me to pay a three year plan of:

$70.00 a month for approximately 3 years with no interest or finance charges. This was told to Rachelle who approved this deal through Paula at Plaza Family Dental. There were no discussions that if I paid a promotional balance of $350.00 to $450.00 that there would be no interest or finance charges. After this deal had been discussed, ALL CHARGES had been reversed and recalculated with a Grand Total of $2,281.00. This was done around October when changes had been made to my account. Rachelle, Office Assistant at Plaza Family Dental, later confirmed that a huge mistake had been made on my account and that GE Money Bank had not been included in the original agreement in the recalculation figures of $2,281.00.instead, I was being charged the original amount of $190.00 for 12 months, which was including interest and finance charges. Rachelle confirmed that this was a clerical error. She personally called the Credit Company and when no results could be achieved, she handed my file to Paula, who assured me month after month that GE Money Bank would fix my account.

In January per attached copy, I had a dispute with the Dentist over my mother's dentures, at the same time I was having a billing dispute with GE Money Bank. The Dentist, Dr. Ambrosio, had made a verbal offer in the presence of my mother and myself that, Since we have tried several times unsuccessfully to fit your dentures right, we can reverse the charges for the full amount and refer you to another specialist who can better suit your needs if we cannot satisfy you. I sent Plaza Family Dental a letter, taking Dr. Ambrosio's generous offer of having the charges reversed since my mother was not satisfied with how the dentures were made. The Dentist then proceeded to go back on his word, denying he ever made this statement and then proceeded to tell us what he verbally expressed to us about improper denture fits.

My February payment of $70.00 was waived until this dispute could be resolved. Paula confirmed with me in February that she spoke with Jennifer, from Merchant Services, Fax #: 800-508-8413, who assured Paula that my account would be fixed with my original calculations. According to Rachelle, Paula informed her of what the Credit Company was in the process of doing and that all changes would be reflected in my March or April Statement. No such changes occurred.

Pursuant to my discussion with a GE Money Bank Customer Service representative on Friday, April 21, the GE MONEY BANK records showed that Paula had made a 12-month payment plan, which amounts to $190.00 a month something that I never agreed to, nor was it ever put into writing that I agreed to such payments.

I repeatedly requested Paula to send her discussions with GE MONEY BANK to me in writing. I called Rachelle on several occasions and asked her to remind Paula to send me my policy in writing. They never delivered my policy in writing where I agreed to pay $190.00 a month for 12 months. I told them, when my credit application had been approved that I could not afford a 12-month plan, but that a three year plan of $70.00 was acceptable. It was clear that there would be no interest or finance charges.

This dispute was faxed to GE MONEY BANK and given to PLAZA FAMILY DENTAL over and over and over again from January through April and this issue has still not been resolved.

Let's work together and try to come up with a reasonable solution to fix my account.

I have made about $390.00 worth of payments now and my account should be down to the above stated amount.

Dear Jennifer:

Pursuant to my discussion with Rachelle & Paula at Plaza Family Dental during the months of January, February, & March this letter confirms that Paula negotiated with you, Jennifer, at Merchant Services to fix the errors on my account to bring my account current. This letter confirms that my account, after 2 months of negotiations, still has not been fixed.

Let's do the math.

About 3 years/36 months X $70.00 a month = for the final amount of $2,281.00 of charges incurred at Plaza Family Dental. This was the plan I originally agreed to at Plaza Family Dental verified through Rachelle and Paula.

This was to be paid with NO INTEREST OR FINANCE CHARGES. The amount of $1,425.00 on 8/8/05 and $350.00 on 10/5/05 was reversed, re-credited and revised under a new payment plan, which would include additional amounts up to $2,281.00.

The original calculations, as stated in GE MONEY BANK'S Customer Service attached letter, were re-calculated and reversed between Plaza Family Dental and GE Money Bank, with a new payment plan that would include a total amount of $2,281.00 in TOTAL charges with a credit limit of $2,400.00 WITH NO INTEREST OR PRINCIPAL CHARGES to be applied. I agreed to these terms.

What I did not agree to was AFTER my new statements had been sent with FINANCE CHARGES and INTEREST being charged and on one statement GE Money Bank said, PAY $450.00 FOR PAY DEFERRED INTEREST. According to Rachelle with Plaza Family Dental, she said, That's because GE MONEY BANK forgot to make changes after we reversed the charges and performed the re-calculations. Don't worry, Paula will negotiate with them and fix the problem.

At the end of January I was negotiating with Plaza Family Dental to have all charges dropped or reversed, due to my mother's dis-satisfaction with the outcome for two sets of dentures that weren't working & fitting properly.in January Dr. Ambrosio had made the comment, If I cannot satisfy you then I will reverse the full charges and refer you to someone else who can best help you. We accepted his verbal offer.in addition to requesting that my account be put on hold, I also wanted the CLERICAL ERRORS associated with my account fixed.

MY FEBRUARY PAYMENT had been waived and postponed until these billing disputes could be resolved. Jennifer at Merchant Services confirmed with Paula that my February payment would be waived, but that I must make my March payment to bring my account current. Jennifer with Merchant Services assured Paula that my account would be fixed and that all changes should be reflected in my April statement. NO SUCH CHANGES WERE REFLECTED IN MY STATEMENT and the attached letter of March 20 was sent to me after my payment had been received on March 23 by GE Money Bank for my 5th April Payment. I received the attached letter on March 27.

As of April I have now made 5 payments of $70.00 which amount to approximately $350.00 as of April with my account current.

$2,281.00 MINUS $350.00 = $1,931.00 (Plus a few dollars more that I paid off).

Please fix my account and bring the account current to reflect all such changes.

The attached letter does not represent the terms of our agreement accurately and needs serious revision, according to the re-calculations done after those charges were reversed, re-calculated, and revised as new totals amounted up to $2,281.00. With 5 payments of $70.00 or more made, my account should be down to $1,928.00.

JENNIFER, please send me a confirmation letter of your discussions with Paula at Plaza Family Dental as she stated you would fix my account WAY BACK IN FEBRUARY.3 months have passed and for 3 months Paula has stated that she had positive conversations with you that gave me assurances of my account being fixed.

You have received my April payment on March 23, per confirmation receipt U.S. Postal Service. As you can see this payment was made WAY IN ADVANCE. Also, a LATE FEE had been applied on 3/13 on my April Statement which is a clear violation of my March payment made on March 1 per confirmation of U.S. Postal Confirmation Receipt.

ALL LATE FEES, FINANCE CHARGES, AND INTEREST CHARGES NEED TO BE DELETED and my 5 PAYMENTS should make my principal balance drop down to $1,928.00.

I will resume my monthly payments until my account is paid in full and I will keep sending the proper calculations for principal paid.

Please fix my account!!!

The following was enclosed with my letter for my april statement

EXHIBIT 6 LETTER & FAX CONFIRMATION OF FEBRUARY 27, with U.S. Postal Service Delivery Confirmation showing proof that EXHIBIT 5, CHECK #438 for the amount of $73.00 was mailed to GE MONEY BANK for March payment. Confirmation Receipt, U.S. Postal Service confirmed that GE MONEY BANK received my payment on March 1.

EXHIBIT 7 MY APRIL, 7 STATEMENT showing account balance of $2,590.30, which is now $190.30 over my credit limit of $2,400.00. Check #444 for the agreed amount of $70.00 is enclosed to resume my monthly payments.

CLERICAL ERROR #1: PLEASE NOTE: APRIL STATEMENT SHOWS A LATE FEE CHARGED 3/11 FOR $35.00. Confirmation receipt shows postal service mailed check on 2/27/06 and delivered to GE Money Bank on 3/1/06. Bank Statement proves check for $73.00 cleared on March 7, ahead of due date 3/10/06. As Exhibit 6 PROVES, my March payment had been mailed with confirmation receipt on February 27 and received by March 1 and my bank statement shows that Check #438 cleared by March 7, which means that THE LATE FEE IS A CLEAR VIOLATION, A CLEAR FRAUD, A CLEAR EXHTORTION OF MY MONEY! It goes to show how negligent GE MONEY BANK is being with my account!

CLERICAL ERROR #2: NEW BALANCE SHOULD BE $1,931.52 as 5 payments of $70.00 or over have been made on time, in advance of due date. No finance charges or interest should have been applied according to original agreement, a fact confirmed between Paula at Plaza Family Dental and GE Money Bank's merchant services, Jennifer during February.

CLERICAL ERROR #3: - A FINANCE CHARGE OF $44.41 APPLIED 3/13/06. This has obviously still not been fixed.

Clerical error #4: interest is still being charged

CLERICAL ERROR #5: My monthly payment plan is $70.00 a month, not $76.00, not $73.00, and not $71.00 a month. On a couple of payments I made a payment of $73.00 and $71.00 and $72.00. This time I am making my original agreed payment of $70.00 to bring my account balance down to $1,928.52.

The track record of Exhibits speaks for themselves. My payments were made on time, yet late fees, interest, & finance charges were incorrectly added. No interest or finance charges should have been applied, yet they were.

As you can see, I have NOW made 5 payments on time which amount to approximately $353.00. This $353.00 should have been applied to the principal balance amount of: $2,281.52 to bring the total balance down to $1,931.52. UNDER EXHIBITS 6 & 7, I have enclosed Check # for the amount of $70.00 to be applied to my March 10 statement which should bring my account balance down to

$1,928.52 = account balance that should be reflected in my may if above clerical errors listed above are fixed & adjusted accordingly.

Care One Credit initially informed the receptionist at Plaza Family Dental that a 3-year plan of $70.00 a month was the agreement with NO INTEREST OR FINANCE CHARGES!

Since Dr. Ambrosio stated he could not reverse the full charges for the entire amount, it was agreed that I would resume my monthly payments, but that NO INTEREST and FINANCE CHARGES should have been applied to my account from the very beginning. It was clear to both Rachelle and Paula at Plaza Family Dental that Care One Credit/GE Money Bank had made a mistake with my payment plans and that corrections to my statements should have been made. Paula has been aggressively negotiating with Care One Credit to have these necessary adjustments made.

Paula, with Plaza Family Dental, contacted Jennifer with Merchant Services on February 27 and Exhibit 6 was faxed to confirm our discussions. Jennifer told Paula she would fix my account and that such adjustments would reflect in my April Statement. Well, this hasn't happened yet.

I would like to see all these changes reflected in my April Statement so that I can resume payments. When I make a payment in April I expect that such a payment will bring my account balance down to $1,928.52.

My April 7 statement is now $190.30 over the credit limit showing a balance of $2,590.30 WHICH IS A MAJOR MISTAKE. I paid my March statement on time, IN ADVANCE, but you charged me a LATE FEE on my April Statement, showing evidence of ACCOUTNING NEGLIGENCE with my account.

Paula stated that CARE ONE CREDIT/GE MONEY BANK should have sent me a letter within 5 to 7 business days showing these adjustments BEFORE my February statement was due to reflect these changes. No such letter was sent to me and nobody at Care One Credit/GE Money Bank called me or sent me correspondence. THIS ACCOUNT HAS STILL NOT BEEN FIXED AND SHOULD BE FIXED FOR MY MAY STATEMENT.

How do i feel as a ge money bank customer?

I am extremely unhappy and angry that my account was not handled appropriately!

Dear Billing Dispute Manager of Care One Credit/GE Money Bank:

Pursuant to my discussion with Rachelle & Paula at Plaza Family Dental during the months of January, February, & March this letter confirms that Paula is still in the process of negotiating with Care One Credit/GE Money Bank to fix my account, as there was not suppose to be any FINANCE CHARGES or INTEREST on my account. I was to pay principal balance only. This account was to be placed on hold as of January 23 until all disputes could be resolved. Paula confirmed with Jennifer at Merchant Services of GE MONEY BANK/SAFEGUARD that this account had been fixed, February charges had been waived and that if I made my March payment, the adjustments would be reflected in my April Statement. I have now received my April Statement and no such changes have reflected in my April Statement. I have two choices: Either refuse to pay for this messed up account due to Care One Credit's accounting negligence, which I define as either fraud, racketeering, or exploitation and I can default on this loan, thus taking you to court, or I can continue making my payments until your company can fix this problem. I think I will continue making my payments until this problem is resolved.

I will instead continue to make my monthly payments on time and itemize MONTHLY what my financial statement should look like until you can correct the clerical errors associated with my statements. It is obvious that your system has a clerical error problem and whoever is handling my account should be FIRED IMMEDIATELY!

We would like to accept Dr. Barr Ambrosio's proposal to have all charges on our GE Money Bank Account reversed, as he stated, If I have not satisfied you, then I will reverse the charges and refer you to a specialist. We would like to accept Dr. Ambrosio's generous offer as soon as possible. A copy of this letter has been given as a formal statement to the office of Plaza Family Dental on behalf of the Newcomb family.

We want to thank Dr. Ambrosio and his staff for their politeness, their patience, their willingness to assist us with getting credit established for lab fees, and for doing their absolute best to work with my mother's dentures in order to please her. However, from the very beginning my mother's dentures did not fit properly. Our insurance through Safeguard covered everything except lab fees.

Our dis-satisfaction does not merely rest with the fact that my mother's dentures, upper and lower, for two different sets did not fit comfortably, but we are not satisfied with the financial arrangements of this deal, which were not fully explained to us by either the labs or the credit companies. Plaza Family Dental is only the mediator between the customer and the financial firms. As a mediator, they disclosed information to us as it was given to them, however, the information was deceptive and completely not to our acceptance or approval.

It is the Newcomb conclusion that the lab financiers and the Credit Company financiers were not straightforward with Plaza Family Dental or with the Newcomb family and were not communicative at all with us during the time my mother needed new dentures.

What was not explained to us before the work was done:

1. My mother would get lower and upper dentures and as her gums healed and adjusted that the dentures would simply be re-aligned until permanent dentures could be obtained in a year from the original denture fit.
2. The lab did not make it clear to us that if my mother's dentures did not fit properly or be re-aligned properly that we would be charged an additional $450.00 for uppers and lowers if the first set did not fit properly.
3. We paid $450.00 for new lowers, after the first lowers weren't fitting. We paid $125.00 extra to have the uppers remolded and the uppers still didn't fit snugly. We charged GE Money Bank about $2,300, now $2,455.00!

BEFORE my mother's teeth were pulled, Care One Credit c/o GE Money Bank, informed the Receptionist of a three-year payment plan of $70.00 a month, in which the card could be paid off within three years. What the Credit company did not tell the receptionist was that approximately $1,800 of interest would be added onto this initial credit payment plan. If the Newcomb family had been informed before accepting the Care One Credit proposal, we would not have applied with Care One Credit. We would not have accepted such a high interest rate. We applied with Care One Credit under the impression that we would be paying only $2,000 off over a three year period and not over $4,000.

Please find attached copies of statements sent to me by GE Money Bank. As you can see, I made my minimum payments on time, with the impression that my mother's dentures would fit good to her satisfaction, but the interest kept the principal balance from moving even one cent. On my last statement, the most recent statement, they decided to lie and charge me late fees, even though I mailed my payment postmarked three days before the payment due date. There was also a ridiculous finance charge added onto these untrue late payments. My payments were on time and after making three payments of $71.00 to $72.00 a month, the principal balance only went up. So I feel that we have been deceived, lied to, and ripped off by this credit company who took advantage of my mother during a time of great need.

Now the credit company is only going off LAB FEE charges. What was not explained to us by the LAB BEFORE doing all the work, was that their work wasn't guaranteed success the first time around. They did not assure us that if the first set of dentures didn't work out, that they would work until my mother had comfortable dentures at no cost or obligation. They only kept re-charging us more money to redo a job that should have been done right the first time. The lab had to do the lowers and uppers twice and still did not fit comfortably for my mother, much to the dismay of Dr. Ambrosio who did everything he could to try to make these dentures work.

After Dr. Ambrosio attempted several times to help my mother's dentures fit right, after a few lab fees later, Dr. Ambrosio called a lab technician into his office to see what he could do. My mother was sick with medical complications and was uncomfortable by the time the lab technician arrived to assist her. Before and after the lab technician came to adjust the second set of dentures, my mother still was not comfortable with the dentures.

The lab also did not inform my mother or myself or Dr. Ambrosio's office of the potential toxicity risks of Denture Cream. If my mother and I had been informed of Care One Credit's ridiculous interest rates; of future lab fees that WOULD accrue if the dentures didn't properly fit; of the toxicity risks of all denture creams, we would not have had all of my mother's teeth pulled.

I do not blame Dr. Ambrosio for not explaining to us the toxicity of Denture Cream. Although we explained to the Dr. That my mother had heart complications and that she is sensitive to many chemicals, he simply did not have any awareness of the potential side effects of denture glues on a human body, or in particular, my mother's body. He could not have predicted that Denture Glues would poison my mother's body and cause her to become sick.

I had not studied Denture Cream until my mother started having problems with shivering, shaking, and terrible heart palpitations ever since she started using Denture Glue in order to make the Dentures stick to her gums since the Dentures were not resting comfortably on her gums.

PLEASE FIND ATTACHED a full report of the ingredients of Polygrip and Fixodent Denture Creams. My mother, after two months of using denture glue, started having massive health problems. She started having medical complications right after the denture creams were applied.

My mother is now still struggling to eat her food and the dentures are still not snug after paying well over $2,300. Dr. Ambrosio made a generous offer to reverse the charges if we felt that he could not satisfy us and would refer us to a specialist and we would like to take advantage of this opportunity.

Although we are grateful to Dr. Ambrosio and his wonderful staff for their assistance, we are simply not pleased with the lab results, the lab policies, the lab fees, and with how Care One Credit did not fully explain to Plaza Family Dental or the Newcomb family, in writing or verbally what the interest rate on the current balance would be.

We want to see those charges reversed and to cancel CARE ONE CREDIT permanently as their interest rates, their finance charges, are too much to pay for no good results.

Once again, none of the above factors are Dr. Barr Ambrosio's fault. He did the best job he knew how. I just don't think that the financiers were being honest with his office or with the Newcomb family from the beginning. And the Newcomb family feels that they shouldn't have to pay for something that doesn't work for my mother or make her feel comfortable with eating. Currently, my mother is not using any denture glue and trying to eat without denture glue. She is now having to see a doctor as a result of two months worth of Denture glue poisoning her body and causing her medical complications for which she is seeing a doctor. Since declining the use of Denture Cream, she is starting to feel better, but is still unstable.

Since Freddie from the Lab is just getting over his flu and could not meet us last week as a result of being sick, my mom does not want someone just getting over the flu to do any more work on her. She needs time to heal and recover from her illness before any more work can be done.

Please reverse all charges and cancel our contract with Care One Credit c/o GE Money Bank, and allow us to accept your referral to a specialist who can help my mother get the results she is looking for. We would also look for another credit company who can offer us a reasonable interest rate with a reasonable contract.

Dentist denture glue letter 2

1. Before operating on my mother, my mother was not informed that she wouldn't have much gum retention to hold the dentures. It wasn't until after the surgery and until after the dentures were placed that he informed her that she doesn't have much gum retention for her lower dentures. My mother did not appreciate the fact that she was not advised BEFORE surgery that she wouldn't have much gums to work with on obtaining retention for her lowers.
2. According to several professionals on several online websites I researched, my mother should not have had to use any denture glue and the dentures should have fitted snugly and if not, then only a small amount of denture glue should have been applied. This was not explained to my mother. When my mother told the Doctor that she would have to use large amounts of Denture Glue he said, Okay, do that. He did not advise her that it might be harmful to her or that the ingredients of the denture creams might be toxic to her system. He advised her to use whatever amount of Fixodent and Polygrip was necessary to get retention. BIG MISTAKE! She used large amounts which poisoned her. She should not have had to use such large amounts, during which time several shavings and adjustments had to be made.
3. I had to pay twice for two different sets of dentures? I had to pay $4,000 and not $2,000 because of unexplained interest and then adding ridiculous finance charges for dentures that did not work the first time?
4. The mere fact that the Lab didn't guarantee their work, THE FIRST ROUND after paying $900.00 for uppers and lowers, then to charge $450.00 more for new lowers and then $150.00 for a remold of the uppers, and THEY STILL DON'T FIT SNUG; to have the dentist give up after the specialist arrives and says, I'll have the charges reversed I cannot satisfy you and refer you to a more costly specialist, only convinces me that this is a ponzi scheme and not a legitimate business that could help my sick mother obtain comfortable dentures. The first round should have been worked with. And they were NOT GOOD QUALITY DENTURES THE FIRST TIME AROUND! The fact that my insurance covered everything except lab fees and then to excessively charge me lab fee after lab fee to rack up my credit to the maximum limit is RIDICULOUS. I am not paying ONE MORE DIME TO ANYONE as this second set still isn't fitting properly.

This is the nature of my problems with this ge money bank. I contacted the better business bureau and ge money bank refused to return calls or contact bbb. I have copy of that letter and all correspondence that was sent for 6 months to ge money bank. They have pyramided my late fees, interest, finance charges and cornered me into a deal i never signed or agreed to. I would prefer at this point to see them in court. If there is anything you can do to assist me, it would be greatly appreciated. I am filing this complaint with you as a matter of importance.
