The complaint is because some 3 1/2 years after the Padded Wagon moved me they initaited a lawsuit against me for stopping a $2000 check WITH CAUSE.

There are several issues here the Padded Wagon seems to be trivializing and taking out of context.

1. The total cost for the move was estimated to be $10500, not simply $2000 as he states and in fact the move was broken down into five components.
A. First, the cost of the packaging materials to pack up my apartment.
B. Second, the actual labor involved in packing the apartment.
C. Third, the actual cost of removing the items from the apartment.
D. Fourth, the actual cost charged for storing my items for six weeks because the contents were not to be moved until my house was ready.
E. Fifth and last, the delivery of the items to the next address.

2. Padded Wagon made me pay for each component outlined above in advance by either cash or certified check.

3. After the fourth component the charges were in fact in line with the originally tendered estimate.

4. On the day of the delivery to my new house I was told that the charges for that day were in fact more than double the estimate or $3500 instead of $1500. It was because of this overcharge that I needed to write a check the subject $2000 in the first place. I might also add that work would not commence until the money was paid so in fact I was charged for six men to sit in my driveway and wait while I went to the bank to get a certified check. It felt as if my belongings were being held for ransom.

5. Upon unpacking we noticed that an antique chest of drawers had its leg broken. See picture. The office was immediately called and I was told an adjuster would come take a look at it.

6. See the two attached faxes requesting that the adjuster come look at it.

7. The check was stopped because I was told that an adjuster was according to Padded Wagon, not going to be available anytime soon because of their busy schedule.

8. Nearly 20 phone calls were made over the month or two which were all stone walled or not returned.

9. A claim was made in a timely fashion and unilaterally ignored.

10. Padded Wagon waited 3 1/2 years to bring this action without so much as once tendering a bill.

11. This behavior defies consumer standards of fair and just business practices and to me seems not to be up to the ethical and moral standards that ought to regulate and protect helpless consumers from this type of behavior.

Typical moving company last minute extortion tactic. I signed that I received the stated number of boxes. They were unopened and one couldn't possibly know the condition of the contents within. Secondly, not one but two claims were made on insurance and were simply ignored. Thirdly, when your balance current balance is $1540 and you are asked for $3540 that is over 100% surcharge. Forthly, the State of New Jersey is currently sueing the Padded Wagon (among others) for just this kind of consumer fraud. Fifthly, the Padded Wagon selects an attorney to represent them that was involved in a "kickback scheme".

Need I go on. USE AT YOUR OWN RISK has never been a better statement. Oh and seventhly, why did they wait 3 years to sue me? Answer because they believe that my right to sue for insurance related damages expires in three years. Hey Padded Wagon, did I forget something?
