I was doing a bathroom remodel. I origanlly went to menards to purchase a hot water heater. I returned a couple of days later to puchase a shower kit.
I decided to get a few other items including a tub. Under the lighting the tub appeared to be yellow. Color really didn't matter because the employee retrieving the tub wrote down the code and color from the tub.
After repeatedly saying I didn't want the white one because that was what I was getting rid of; I went through the aisle only to discover that he had given me the white one anyway.
So I sent my friend, who I take with me when I'm doing a project, over to customer service where he then met up with Sharon. Sharon became very disgruntled because he said yellow and not almond.
To difuse this I gave my friend my reciept and asked him to find the employee who got the tub down so that he could straighten it out. I thought maybe she didn't realise he was deaf scince she never looked directly at my friend.
I then walked over to her and tried to explain the situation. Once again she became disgruntled and started fussing at me as though I was a child of hers. Everytime I tried to explain to her that at this stage color didn't matter because the employee who had taken it down would know which tub it was.
She never allowed me to even complete the statement. She just kept on fussing. I told her I didn't appreciate the way she was speaking down to me and she just continued.
I then pushed the cart with my other purchases over by the door. This was more for cooldown time. I then noticed the other cashier had wittnessed this and too was shaking her head in disbelief of Sharons behavior. I wanted to leave but couldn't because the store had my money and merchandise.
I again tried to explain to her why I said color didn't matter and she just resumed fussing at me. This to me was amazing at how much I had to endure without a manager saying anything. Maybe this is common practice.
I then told her I was gooing to report her behavior. This is when Sharon got extra loud. At this point a White male in plain clothing walked over And got in my face and started yelling.
I asked him did he even want to know what happened and he screamed 'SHUT UP!!!'
I couldn't believe that I still was not allowed to speak. Sharon in the mean time was still yelling and was never told to calm down. If I spoke "SHUT UP" was all I got.
I asked on several occassions what his name was and he refused to tell me. He finally told me to leave. I informed that I couldn't because they still had my money and merchandise.
He then asked would I accept the money back.BY now Yes was my answer. He told the other cashier who saw the whole thing too ring me up and give me my money back.
She said she couldn't because I had given the reciept to my friend to go and clear the problem up. He then screamed "Leave you can't have your money or mechandise." I of course said give me my money back. If you keep my money I'll sue.
He then said 'turn around and put your hands behind your back. Do you know who you're talking to? You're talking to an officer, officer, officer of the law.' The security guard who had walked over with him handed him his badge. He stuck this extra small badge right in between my eyes and then stuck the badge in his back pocket.
Even though I didn't agree with this I complied. He then began trying to slap the cuffs on one wrist. While trying to do so he kept missing and was hurting my wrist. I asked him what he was doing and he once again screamed 'SHUT UP!' You're goin' to jail.
After several failed attempts he then closed the handcuffs on my wrist with a lot of force. This caused me react by crying out in pain and snatching my arm and showing him what he had done to my wrist and asking him why didn't he just put both of my hands in handcuffs in stead of torturing that one arm.
I asked the other cashiers did they see this. The cashier who had seen everything was still looking just as dumbfound as i was.
He then took me outside in that one cuff. Once outside and out of sight the security Guard who works for Trinity Secuity gradbed my other arm and swiftly put my other arm in hand cuffs.
All the while the so called police officer was gouging that hand cuff into my right wrist. He then walked me further away from the entrance. He finally asked, 'You know why I had to do this?'
don't you. I replied, "No. Why did you have to do all of this."
'Because you hit me.' I replied, "No I didn, t.
He then raised his left arm and applied pressure with his left forefinger and drug it up his arm. I responded by saying "you're not really going to due that right in front of me are you?"
He then radioed for the police who then followed his lead and immediatly started yelling at me. Finally I able to give a partial statement because once again Shut Up, was all I heard again. I asked officer Drake would he please loosen the cuffs and heresponde, " Oh you're alright."
By now the customers who had seen what had transpired in the store were now outside. When the police arrived the took staments from the customers but did not include their statements in the reports. A lady was also taking pictures of the situation. Everyone was just as dumbfound as I was.
One customer asked why didn't he just give me my money back so I could have left instead of letting things get this far out of controll. He also asked him why he took so long in idetifying himself.
By now the the manager, Mike' came out and yelled "That woman didn't say nothing to you." How would he know he wasn't there.
By now my friend had came out. He asked what was going on. He said that Sharon had found him in the store and started yelling at him again. Oh and by she still never noticed friend is deaf. This woman could do no wrong. She was allowed to argue with a deaf man.
No matter how she behaved she was never reprimanded. I just couldn't believe what had just transpired. I paid for the merchandise at 8:15 and at 9;00 I was still in handcuffs and in pain. That was 45 min. Before the socalled police officer finally called for the police.
The officers told him he had to give me my money back and his response was, "I'm not givin' it to her. I'll give it to him" pointing to my friend. Just as he said in the beginning that I couldn't have my money back he meant it. He never gave me my money back.
Finally I was released and given a victim card by officer Drake.
He said, "take this on down there and see what you can due with this and haphassardly gave it to me.
I now know exacly what he meant. They were not going to allow me to press charges. He asked me a question using police lingo and it took me a minute to realize what he had said. He wanted to know if I wanted pictures taken of my bruises.
I asked if that was what he meant. And his response was"I was."
He then just walked away. I said well I guess I'll just have to take my own.
A couple of weeks later I was ordered in for processing with three charges against me. I myself was not allowed to report anyone any attempts only lead to me being hollered and screamed at. The funny thing is I was the one they accused of being beligerant. I had a head ache for days after all of that screaming in my ears.
In the report they do not mention the Trinity security guards' role in this. He saw the whole treatment and only stood there smiling with no badge or name tag. They don't even mention how Sharon first fussed at my friend and then me and then found him to fuss some more. They refused to take the other cashier who truly saw everything statement. I was never given a fair chance.
They even took back the stuff I wasn't trying to return.
Correct me if I'm wrong< would you justleave 279.00 at a store?
By not giving them my money I get in trouble. Isn't that stealing. Maybe even blackmail. Leave the money or go to jail those were my options. I would have gladly left with my money.
I still cry. I can't beleive what happened.
They lie in the report and say my friend bought me the tub to cover for not giving my money back. It also says he is the store manager. The report makes no mention Mike the guy they identified as the manager that night. Who's who. I don't know.
Brian Hedges is his name. Who or what he is may never be clear. The race to convict and cover is on and I don't know where to turn.
My lively-hood is in jepardy because of a mistake they made.
I still have items I cannot use or return. I took a nice loss with this. They are simply trying to take away my rights to make things right.
