Company or 3rd party markete

I was looking at entering into a distributorship with them, but after reading the previous posting I am very concerned.

1) How can I tell if I have been speaking to a company sales person or a 3rd Party marketer?

2) Holiday's literature states that they will "take" back any underperforming products. Are they charging to do so?
