I was served with a Summons and Complaint from Midland Funding LLC, by its servicing agent MIDLAND CREDIT MANAGEMENT INC.

I was ordered to appear on November 28, 9:30 A.M., and file a written answer and provide a copy to the plaintiff or plaintiff s attorney on or before the date and time stated. Both of which i did.

In the complaint Midland Funding LLC stated (paragraph 3 "the plaintiff is in the business of purchasing debt, and is the successor in interest to Chase Bank USA NA, the original creditor involved in the credit transaction described below". They went on to identify account number of said debt and current balance due as of October 24.in paragraph 7 "the defendant refuses to pay this deby despite due demand having been made by the plaintiff", since i had never heard of Midland Funding LLC before that date this is a lie.

This information was made available to me by Kohn Law Firm S.C., 735 n. Water Street, Suite 1300, Milwaukee, WI 53202-4106.

During the time stated by Middland Funding i was undergoing ratiation and Chemo and post cancer treatmen for cancer and some of my lessor debts were either forgiven or settled. I cannot recall if Chase Bank fell into this category or even if i had a credit card with them. All i received were some copies of statements with my name on them showing charges of interest and fees (no charges). I sent a request for all pertenant information in original format show my original signature with Chase or Midland showing agreement for payment with original receipt of charges of same and demands in writing for payment thereof. I received a stack of (copies) showing my name and charges of interest and fees, nothing in it's original format.in an affidavit of sale of account by Chase to Midland it stated, being duly sworn and deposed by a Martin P. Lavergne, that "a pool of charged-off accounts" had indeed been sold to Midland and his statements were true to the best of his knowledge". This was dated March 29.in accordance with FDCPA if anyone tries to collect a debt from you that has been filed against the original creditors federal taxes or business insurance it is extortion and against the law, and if the collector is not the original creditor you DO NOT have to pay a third party debt collector. I apprised the judge of this fact and since the defendants did not deem it neccessary to appear in person but buy, which made it difficult to hear, they rattled off some step i did not adher to and judge decided in favor of the defendant. End of case, even though the defendant had clearly broken the law and committed a crime.
The judge reiteritaed it was not the courts business. Nor how they chose to collect the alleged debt.

In my case i realize it is to late, but for citizen of this state i believe these people should not be allowed to buy other individuals private information and extort them of their money. I am 69 years of age and disable. I live on my Social Security and i have no assets, now i am going to be besieged by phone calls and letters from these people demanding payment which will add up to thousands more by the time they add their fees to it.

After some investigating on the internet if have found there are hundreds if not thousand of people that Midland has extorted monies from. Several Attorney General have sue them and won for illigal procedures.

I ask for help from JudaCare for assistance and was turned down.

My question to you is would it be possible to provide legal assists to those of use who cannot afford legal council so some other citizen of this state is not screwed (please excuse my language) by this company? My generation was taught if you owe someone you pay them or otherwise work it out to both parties satisfaction. I am certain the majority of Middlands suits are brought against the elderly because most will just pay fearing retribution.

If it is not to much trouble could you please respond to inquiry. It would at least ease my mind to know at least someone cares enough to listen to this travisty of justice.
