Dear Mr. Swanson:
1- Happy New Year to you and to Raytheon and its Engineers and all employees who all Nagui’s colleagues and friends.
2- I have not received any response to my letter to you dated November 21 that was concerning the response to Mr. F. Kinsey Haffner, Raytheon Vice President Intellectual Property and Licensing, dated November 20. The use of the US Patent in the Three Radar Programs in sales to Foreign Countries requires Licensing of US Patent 6,411, 512 in the use of its applications in the fluid cooled (liquid and air) three Radar programs of;
The liquid cooled; THAAD radar at Raytheon IDS with the TRIMMS packaged on the heat pipe embedded cold plate cooled on the two longitudinal edges which infringes on the ‘512 Patent.
The air cooled; AN/TPQ 37 RMI Fire Finder Production radar.
And the air cooled; AN/MPQ-64/F1 Improved Sentinel surveillance radar.
3- All what we are asking Raytheon/Thales Raytheon are to follow the law of the land and make legal the use of the US Patent in the above three Radar Programs sold to foreign entities. We do not need to take Raytheon/Thales Raytheon to Court in order to get our legal rights. Raytheon/ThalesRaytheon are major US Government Contractor (using Tax Payers money). Raytheon should be following its business rules towards its Engineers and towards every American and in its business all around the world. If any business with Raytheon people or companies or entities have to go to Court in order to get its legal rights it is also illegal. Nagui has gone even further than that and he did not got his rights until now. If Raytheon is always is dealing with in its business in bad faith it is illegal. Raytheon should not waste millions of dollars in Attorneys fees and Courts at every move that is supposed to be straight forward situation like in this situation. Nagui has contributed directly to the FireFinder and Sentinel Radars and in writing on his email to the team dated August, 5 and stated in clear words that he holds a US Patent and using the US Patent in his proposed solution; Mankaruse; et al 6,411, 512 is used in the two Radar Programs (FireFinder and Sentinel). Dave Stevens (FireFinder Technical Director) in the first few months tried to avoid using this US Patent and employed tens of cross-company top Raytheon Engineers to find a different technology (not patented), but he failed. Then Dave called Nagui at 4:00 PM in that day in his office asking him if he can meet in Dave’s office for half an hour. Nagui discussed the issues of his concern; (how is this technology work?) until 7:30 PM and finally, Dave asked Nagui what if this did not work? Nagui replied if it did not work there is no Program, then Dave said; That is what I am afraid that you are going to say.
4- Nagui spelled in writing in clear language what was in his state of mind that the technology of the US Patent can be used to make the FireFinder and Sentinel Radars work and solve the problem.
5- Regarding the THAAD program; it is infringing on the same US Patent also and at least the sale of this Radar to UAE of December 30 is known to us is also eligible for Licensing by Raytheon to legalize the use of the US Patent.

Nagui has physically saw the THAAD radar at Raytheon IDS with the TRIMMS packaged on the heat pipe embedded cold plate cooled on the two longitudinal edges which infringes on the ‘512 Patent.
6- Nagui’s contributions to the AN/TPQ 37 RMI FireFinder radar and AN/MPQ-64/F1 Improved Sentinel surveillance radar used one of the applications of the ‘512 Patent. Nagui has emailed the solution to the cross company team in his first email to the team dated August 5 @ 11:01 AM. Both radars are strengthened our Country in our defense and our allies all around the world.
Nagui wrote;
(Subject: RMI – Sentinel PAM Thermal Study: The thermal issue of the PAM’s discussed this morning at the Radar Lab Testing site in Fullerton can be addressed to allow better cooling of the high temperature of the TWT and the High Voltage Power Supply by using the technique I have very much used in similar situations and have extensive experience with including patents. This technology have been used so far in many Military/Space and in way to be used in commercial applications as well for cooling computers and super computers and other commercial applications.)….
Nagui knows that the FireFinder and Sentinel Radars are sold and selling to different Foreign Allied Countries around the world which make these sales eligible to Licensing by Raytheon/Thales Raytheon for these sales.
All these information are documented in writing and by credible tens of high level Raytheon/Thales Raytheon Engineers, Managers, Directors, Vice Presidents and Presidents.
Conclusion:
7- I am asking you to put an end to this dispute now without any further delay by asking the Raytheon Intellectual Property & Licensing Organization to take the steps towards preparing licensing agreement without delay to these three Radar Programs sales to all Foreign Allied Countries and NATO and Raytheon to comply to the USA Laws and save Tax Payers Money.
Nagui and I are looking forward to your quick reply.
