Ripoff artist that were turned into Attorney's lawsuit

I have been receiving magazines from National Magazine Exchange for a year, completely unwanted. I read the rebuttal from the N.M.E. Employee, and he is correct that I would not have been in this situation if I had not called in response to the second notice regarding my $1,000, 000.00 (that's a Million!) sweepstakes ID number. Yeah, I wanted to win Money. Shock. But, once I received the magazines and no other letters regarding this Great sweepstakes, I called the Customer Service number.

The CS Rep was very helpful, sent me to Tom, the A/P Manager to cancel my order. Tom even sent a letter three days later, stating "that in reference to my recent request, the balance on my account is $0.00." and "if THEY could be of further assistance to me regarding this matter, please feel free to write them at the address listed on the letter".

10 months later, I receive a letter from N.M.E. Stating that 'You could "strike it rich" as the million dollar winner!', attached to a order for the magazines I cancelled in January and a bill stating, 'Thank you for your INITIAL payment of $67.08 and You have 3 remaining payments of $67.08, THEN your account will be paid in full.'

I totally ignored it BECAUSE I have already cancelled it. Well, a month later I received a Past Due Notice from the Director of Collections that they MUST receive a check for the installment payment of $67.08, or the remaining balance of $268.32, by 12/13/03 or my account would go into their delinquent file.

I was angry. I felt that if I received hard copy of a cancellation, it should stay Cancelled! Oh, by the way, I am a Senior Collections Specialist for one of the Largest Soft drink Companies in the World. So putting me on Collections, will get you hunted. I called N.M.E., spoke to Michelle, A/P Manager (what happened to Tom?) she "cancelled" the order and said she would send a confirmation letter to this fact. That was 12/08/03 and still no letter.

I turned in this great company into the Better Business Bureau of West Florida and added my complaint to the law suit handled by Hoyer, Newcomer & Smiljanich. The attorney's website is set up to take all complaints regarding N.M.E. (www.jameshoyer.com)
Good Luck to anyone being hustled by this company. This will be the hardest collection case I have ever fought... But I will win.
