Matthew sherman ripoff liars dishonest fraudulent ripoff

On August 10, we purchased a Power Acoustik PA-DVD 500 5 disk dvd change through the www.gift-catalogue.com website. We paid an additional $32.99 for 2-day shipping also. We attempted to contact them by phone and email to confirm shipment but never received any response.

The item was finally shipped out on the 15th and received by us on the 19th (considerably longer than 2 days).inside the box was a different item - the PA-DVD 300, a single disk dvd player.

My wife promptly sent emails through his website and the customer service links as instructed and when we received no response she sent another to him and to every contact email listed on the site. No response.

On the 20th, I left repeated messages on his voice mail and could get no response, but luckily he finally answered the phone himself. He offered to sell us the one we had for $130 but we declined and he said he would have Airborne Pick it up and would send the correct one.

10 days passed and our repeated attempts to contact him got no response. Finally on 8/31 my wife notified paypal (my payment method) of the situation and requested a reversal. He provided them with a delivery confirmation number through UPS and they accepted that as proof of the delivery. Yes, a delivery was made, of a $130 item which we were quite clear we did not want and for which he collected $349 without our consent.

We have an invoice he enclosed in the box that clearly says that it accompanied the 330 model instead of the 500 and which states that it was shipped by Ground instead of the 2 day mehtod I paid for, and we have the invoice generated by his website for the 500 model we did buy and never received

On 9/13/03 I filed a complaint with the BBB and posted a complaint on http://forums. Baddealings.com/showthread.php? Threadid=1195&goto=newpost where I discovered multiple complaints regarding this company. I encourage the others to file claims also.

On 9/25/03 received email from him playing dumb - called it an oversight and said he would get that processed right away. He asked via email that if he sent the refund we update our internet posting. I agreed via email.

10/7 Received email indicating he was "working on it" and would have a check drawn within the next several days.

10/16/03 notified us fedex would be here the following day between 9-5
with a check.

10/20/03 I sent him an email indicating no sign of fedex and requested a tracking number - which he provided and fedex showed to be invalid - but he assured us was real and that fedex had screwed up and would definitely come through this time.

10/21/03 Fedex did show up but only to retrieve the incorrect item we had received - but did not have our reimbursement. I contacted Sherman by email and he said that we had to return the dvd player first which would be understable and unquestionable given any other circumstances but as he had led us to believe we would receive the check first which was yet another thing he failed to come through with, I offered to ship the DVD player by COD or use an escrow service nd he would be required to give turn over the reimbursement cashier's check before the item would be left with him. He said he would look into it and again we can get no response ouof him.

I also noticed that additional complaints were posted by additional victims on the www.baddealings.com website.
