Hackett Advertising Public Relations Interactive Charged me $7750 for a website and didn't deliver contractual promises!

I needed a website for my frozen yogurt store opening in October. So I looked around and spoke with 3 different companies. When I met with Hapi I spoke with the owner Jason and one of the programmers Mike. They both talked about how great this project would be and how the website they would create would be really super. I liked their energy and we were able to agree on a price. It wasn't cheap by any means at $7750 there was a lot to the site that they needed to create. I got everything in writing from Jason with exactly what they were going to do for me. I paid them half upfront and was expecting them to finish within 30 days, but they fell behind and ended up finishing in about 50 days. They told me up front they would finish sooner, but they didn't. I was OK with this but after they finished they wanted me to make the final payment (which I did). Jason told me that he would get me the information I needed to access the "back end" of my website. I have a site that lets people vote on flavors for the store and I need to be able to go in and delete the votes every week so that customers can start fresh. Well I have no idea on how to do this because he never provided me with the info. I have called Jason several times but he never answers my calls and does not respond to my emails either. Along with this information the following was also promised to me:
Full back end access When the phone numbers entry line will be set to deny anything shorter than 10 digits or all zeros
Proof the ALTA and META tags have been
embedded into the site for search engine optimization (Yahoo doesn't
even return results for swirl it froyo???) Google Analytics set up I have been emailing and calling Jason since the website was launched back in SEPTEMBER and still he has not followed through with our contract. They also told me that they would make a few store posters for me to hang up during construction and that I would not have to pay them for these until after the store opened up. Now keep in mind that they offered that to me before I agreed to do business with them (attempt to sweeten the deal). I told them back in September that I wanted them ASAP to put in the windows. It was the middle of October when I finally got him on the phone about the posters and he told me that my posters were not a "priority" for him because they weren't going to get their money for them until December. I told that was HIS offer, I simply took the deal. I was so frustrated hearing a business owner tell a customer "Their project was not a priority" and because they missed their deadline again by weeks that I wanted the posters canceled. He claimed they had been working on them and the next day I received the file (funny how that worked out). So they wouldn't let me cancel the order, even though they were way behind on them and I didn't get them for 2 months. To summarize, I have spent $7,750 for a website that I have no idea on how to work because the company that built it will NOT return my calls or emails or send me the information and tools THEY wrote in our agreement. Here are some email strings for your review to back up my statements, you can see here that I have been requesting this since September. we'll do the job even though we won't get paid until six weeks after
you open, which puts payment due date right around Christmas. That's fine. We're happy to help you get your business up and running. However,
from a business standpoint we need to slip this job in-between other
jobs with a greater priority. We'll still shooting to get you poster
designs in the next week or so. Thanks Kent. Have a great day! Jason Kent to Jason show details Sep 3 Jason, How is this order coming, I got the store keys today and I am putting the banner up tomorrow. Also I still did not receive all of the info to access site statistics via Google analytics, can I get this tomorrow please? - Show quoted text -

The zip codes should be working by now. I don't know why they aren't.
I'll check on it. I'll also ask for the information for the Analytics
part of the site.

The
problem with the 0's is the POS system is not going to be able to
differentiate the customers if multiple people try and use it. Also
the website will now be vulnerable to people putting in 000 000 0000 as
the phone number and will allow them access to voting.

Voting is a privilege for those who use real numbers and it needs to be as legit as possible. So her 000 000 0000 Proswirler registration number of zeros should not allow her access to the voting feature.

Hi Kent, Any
changes on the site will cost you a fee to make them. I can get an
estimate to you from our programmer and pass it along to you if you
wish.

You should be promoting, if you aren't already, the grand opening on all your social media sites. Let me know how you would like to proceed.

Jason Kent to Jason show details Oct 6 Jason, We
did discuss advertising the grand opening on the home page in our price
and the only "change" is the phone number. I can change the number if
you tell me how to do it. Can you please answer my other questions too please?

I would like to have "Grand Opening Nov 7th, Free Froyo from 5-9pm."

Just wanted to give you a heads up now so you have enough time.

I am still waiting on how to delete a proswirler number and to block all zeros. Can you get back to me please, we never resolved this
Our phone number needs to be updated on the site.

Reply — Thank you, Kent I really did not want it to come to this, but I have made several attempts to get this information from them. Here is an email that I sent them last week with a fair warning, and they did not respond in ANY WAY SHAPE OR FORM. Reply | Kent to Jason, Mike, show details Oct 15 (6 days ago) Hello, Thank you for putting the grand opening notice on the site. I
have asked for the following several times but have not received them
nor have I been told when to expect them and too much time has passed.
If I do not receive this information outlined below (all per our contractual agreement) by Tuesday October 20th I will escalate the matter with my attorney and file a complaint with the BBB.
Full back end access Instructions on how to zero out the flavor votes When the phone numbers entry line will be set to deny anything shorter than 10 digits or all zeros
Proof the ALTA and META tags have been
embedded into the site for search engine optimization (Yahoo doesn't
even return results for swirl it froyo???) Google Analytics set up I
just need what was promised to me in our contract and do not have time
to keep sending emails and making phone calls with no communication.
Thank you, Kent |
